(5) If a proceeding is commenced before the Discipline Committee and the term of office of a member of the Committee expires or is terminated, other than for professional misconduct or incompetence, before the proceeding is disposed of but after evidence has been heard, the member shall remain a member of the Committee for the purpose of completing the disposition of the proceeding in the same manner as if the term of office had not expired or been terminated.

Lorsque après la libération totale ou partielle de la garantie visée à l'article 5, il est constaté que l'utilisation et/ou la destination prescrites n'ont pas été respectées pour tout ou partie des produits, l'autorité compétente de l'État membre où la garantie a été libérée exige, de l'opérateur concerné, conformément à l'article 8 paragraphe 1 du règlement (CEE) n° 729/70, le paiement d'un montant égal à celui de la garantie qui serait resté acquis si le manquement avait été pris en considération avant la libération de la garantie, augmenté des intérêts et calculé pour la période comprise entre le jour de la libération et le jour précédant celui du paiement.
1. Where, after the release in whole or in part of the security referred to in Article 5, it is established that the products in whole or in part did not reach the prescribed use and/or destination the competent authority of the Member State where the security has been released shall require, in accordance with Article 8 (1) of Regulation (EEC) No 729/70, the operator concerned to pay an amount equal to the amount of the security which would have been forfeited if the failure would have been taken into account before the release of the security. This amount shall be increased by interest calculated from the date of release to the day preceding the date of payment.
