L’article 1er, paragraphe 3, de la décision-cadre 2002/584/JAI du Conseil, du 13 juin 2002, relative au mandat d’arrêt européen et aux procédures de remise entre États membres (1) doit-il être interprété en ce sens qu’une extradition aux fins de l’exécution de sanctions pénales est illicite s’il existe des indices sérieux que les conditions de détention dans l’État membre d’émission violent les droits fondamentaux de l’intéressé et les principes généraux du droit consacrés à l’article 6 TUE ou bien doit-il être interprété en ce sens que, dans ces cas, l’État d’exécution peut ou doit faire dépendre sa décision sur la licéité d’une extradition d’assurances quant au respect des conditions de détention?
Is Article 1(3) of the Council Framework Decision of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States (1) (2002/584/JHA) to be interpreted as meaning that extradition for the purposes of prosecution is impermissible where there are strong indications that detention conditions in the issuing Member State infringe the fundamental rights of the person concerned and the fundamental legal principles as enshrined in Article 6 of the Treaty on European Union, or is it to be interpreted as meaning that, in such circumstances, the executing Member State can or must make the decision on the permissibility of extradition conditional upon an assurance that detention conditions are compliant?

Lors de l’adoption de la décision-cadre relative au mandat d’arrêt européen, le Parlement européen a toujours indiqué sans la moindre équivoque que, d’une part, les conditions d’application du mandat d’arrêt européen sont relativement strictes, de sorte qu’il ne s’applique qu’aux crimes vraiment graves, qu’il doit être appliqué de façon proportionnée et qu’il faut harmoniser parallèlement les normes procédurales dans l’Union européenne.
When the European Arrest Warrant was passed as a framework decision, the European Parliament always made it perfectly clear that, on the one hand, the conditions for applying the European Arrest Warrant are relatively strict, so that it should apply only to really serious crimes, that it should be applied in a proportionate way, and that the procedural standards in the European Union should be harmonised at the same time.

(22) That person should also have the possibility to have a lawyer in the issuing Member State to assist the lawyer in the executing Member State in specific cases during the surrender proceedings without prejudice to the deadlines set out in Council Framework Decision 2002/584/JHA; that lawyer should be able to assist the lawyer in the executing Member State when exercising the person's rights under the Council Framework Decision 2002/584/JHA in the executing State, in particular in respect of the grounds of refusal under its Articles 3 and 4; since the European Arrest Warrant is predicated upon the principle of mutual recognition, this should not entail any right to question the merits of the case in the executing Member State; as there is no incompatibility between defence rights and mutual recognition; enhancing fair trial rights both in the executing and in the issuing Member State will boost mutual trust;
