Emphasises the role of the FRA in the continued observance of the fundamental rights situation within the Union and the implications of the Treaty of Lisbon in this field, by providing analysis, assistance and expertise, a task which requires quality, objectivity, effective impartiality and transparency; calls on the Commission to review and strengthen the mandate of the FRA in order to align its work with the new requirements based on the Treaty of Lisbon and the Charter; points out that, within the reviewed mandate, the monitoring role of the FRA should extend to the acceding countries; therefore adequate resources are needed for the increased tasks following the implementation of the Charter; reiterates its request to be fully associated in revising the multi-annual programme of the FRA; welcomes the inclusion of an Annex in the FRA’s Annual report, indicating the ratification by Member States of international human rights instruments;

La Conférence déclare que des contacts appropriés seront pris avec le Parlement européen pendant les travaux préparatoires précédant la nomination du haut représentant de l'Union pour les affaires étrangères et la politique de sécurité, qui interviendra à la date de l'entrée en vigueur du traité de Lisbonne, conformément à l'article 18 du traité sur l'Union européenne et à l'article 5 du protocole sur les dispositions transitoires; le mandat du haut représentant commencera à cette même date et durera jusqu'à la fin du mandat de la Commission alors en exercice.

The Conference declares that, in the course of the preparatory work preceding the appointment of the High Representative of the Union for Foreign Affairs and Security Policy which is due to take place on the date of entry into force of the Treaty of Lisbon in accordance with Article 18 of the Treaty on European Union and Article 5 of the Protocol on transitional provisions and whose term of office will be from that date until the end of the term of office of the Commission in office on that date, appropriate contacts will be made with the European Parliament.

The IGC mandate states that the Reform Treaty will not have a constitutional character. This will be reflected in the terminology used (for example, the term Constitution will not be used and the denominations "laws" and "framework laws" will be discarded in favour of the existing denominations "regulations" and "directives". In addition, the Treaty will not contain any article mentioning the symbols of the EU. In accordance with the traditional method for revising treaties, the Reform Treaty will amend the existing treaties.

Data on persons wanted for arrest for surrender purposes shall also be entered on the basis of arrest warrants issued in accordance with Agreements concluded between the European Union and third countries on the basis of Articles 24 and 38 of the EU Treaty for the purpose of surrender of persons on the basis of an arrest warrant, which provide for the transmission of such an arrest warrant via the Schengen Information System.

(12) This Framework Decision respects fundamental rights and observes the principles recognised by Article 6 of the Treaty on European Union and reflected in the Charter of Fundamental Rights of the European Union(7), in particular Chapter VI thereof. Nothing in this Framework Decision may be interpreted as prohibiting refusal to surrender a person for whom a European arrest warrant has been issued when there are reasons to believe, on the basis of objective elements, that the said arrest warrant has been issued for the purpose of prosecuting or punishing a person on the grounds of his or her sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation, or that that person's position may be prejudiced for any of these reasons.
