Ce dossier a donc été renvoyé à l'Assemblée générale des Nations unies qui, le 2 avril 2013, a adopté à une écrasante majorité le traité sur le commerce des armes par le vote de la résolution A/RES/67/234 B. Le traité a ensuite été ouvert à la signature le 3 juin 2013, et entrera en vigueur dès la cinquantième ratification.
The matter was consequently referred to the UN General Assembly which, on 2 April 2013, adopted by an overwhelming majority the Arms Trade Treaty through the vote of Resolution A/RES/67/234 B. The Treaty was subsequently opened for signature on 3 June 2013 and will enter into force upon the 50th ratification.

Until 31 March 2017, when an act is to be adopted by the Council acting by qualified majority, a member of the Council may request that it be adopted in accordance with the qualified majority as defined in Article 3(3) of Protocol No 36 on transitional provisions, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community.

Where a decision is to be adopted by the Council acting by qualified majority, 65 % of the population of the Union or, where not all Member States participate in voting, of the population of the participating Member States, and the minimum number of Council members representing more than 35 % of the population of the participating Member States shall be calculated in accordance with the population figures set out in Annex III. These figures shall also apply between 1 November 2014 and 31 March 2017 where, in accordance with Article 3(2) of Protocol No 36 on transitional measures, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community, a member of the Council requests that an act be adopted in accordance with the qualified majority as defined in paragraph 3 of that Article and a member of the Council requests that it be verified that the Member States comprising the qualified majority represent at least 62 % of the total population of the Union’.

Where, following a decision to suspend voting rights adopted pursuant to paragraph 3 of Article 7 of the Treaty on European Union, the Council acts by a qualified majority on the basis of a provision of the Treaties, that qualified majority shall be defined in accordance with Article 238(3)(b) of this Treaty, or, where the Council acts on a proposal from the Commission or from the High Representative of the Union for Foreign Affairs and Security Policy, in accordance with Article 238(3)(a).

4. Jusqu'au 31 octobre 2014, dans les cas où, en application des traités, tous les membres du Conseil ne prennent pas part au vote, à savoir dans les cas où il est fait renvoi à la majorité qualifiée définie conformément à l'article 238, paragraphe 3, du traité sur le fonctionnement de l'Union européenne, la majorité qualifiée se définit comme étant la même proportion des voix pondérées et la même proportion du nombre des membres du Conseil, ainsi que, le cas échéant, le même pourcentage de la population des États membres concernés que ceux fixés au paragraphe 3 du présent article.
4. Until 31 October 2014, the qualified majority shall, in cases where, under the Treaties, not all the members of the Council participate in voting, namely in the cases where reference is made to the qualified majority as defined in Article 238(3) of the Treaty on the Functioning of the European Union, be defined as the same proportion of the weighted votes and the same proportion of the number of the Council members and, if appropriate, the same percentage of the population of the Member States concerned as laid down in paragraph 3 of this Article.
