Il convient d’ajouter que, pour autant qu’il est recevable, le présent litige n’est pas un litige à caractère pécuniaire au sens de l’article 91, paragraphe 1, du statut, et que, par conséquent, le Tribunal ne dispose pas en l’espèce d’une compétence de pleine juridiction, ce qui l’empêche d’examiner s’il y aurait lieu de condamner d’office la partie défenderesse au paiement d’une indemnité pour le préjudice causé par sa faute (voir en ce sens arrêt de la Cour du 20 mai 2010, Gogos/Commission, C-583/08 P, point 44).
It should be added that, in so far as it is admissible, the present dispute is not a dispute of a financial character within the meaning of Article 91(1) of the Staff Regulations, and the Tribunal does not therefore have unlimited jurisdiction in this case, which prevents it from examining whether it is necessary for it, of its own motion, to order the defendant to pay compensation for the damage caused by the defendant’s wrongful act (see, to that effect, judgment of 20 May 2010 in Case C-583/08 P Gogos v Commission, paragraph 44).
