Comme en décembre 2001, où le Conseil européen de Laeken[3] appelait « à la mise en place rapide d'un réseau européen pour encourager la formation des magistrats, qui servira à développer la confiance entre les acteurs de la coopération judiciaire », le programme de La Haye considère que l'Union doit notamment s’appuyer sur le Réseau européen de formation judiciaire.
As in December 2001, when the Laeken European Council called for “a European network to encourage the training of magistrates to be set up swiftly; this will help develop trust between those involved in judicial cooperation”[3]. the Hague programme considers that the Union must in particular seek support in the European Judicial Training Network.

Bodies and entities pursuing a general European interest in the field of training of the judiciary, such as the European Judicial Training Network (EJTN), the Academy of European Law (ERA), the European Network of Councils for the Judiciary (ENCJ), the Association of the Councils of State and Supreme Administrative Jurisdictions of the European Union (ACA-Europe), the Network of the Presidents of Supreme Judicial Courts of the European Union (RPCSJUE) and the European Institute of Public Administration (EIPA), should continue to play their role in promoting training programmes with a genuine European dimension for the judiciary and judicial staff, and could therefore be granted adequate financial support in accordance with the procedures and the criteria set out in the annual work programmes adopted by the Commission pursuant to this Regulation.

5. Un État membre peut, au moment de l’adoption de la présente décision-cadre, adresser une déclaration ou une notification ultérieure au secrétariat général du Conseil en demandant une telle validation dans tous les cas où l’autorité d’émission n’est pas un juge, une juridiction, un magistrat instructeur ou un procureur et où la loi de l’État d’exécution exigerait, dans une procédure nationale similaire, que les mesures nécessaires à l’exécution du mandat européen d’obtention de preuves soient ordonnées ou dirigées par un juge, une juridiction, un magistrat instructeur ou un procureur.
5. A Member State may, at the time of adoption of this Framework Decision, make a declaration or subsequent notification to the General Secretariat of the Council requiring such validation in all cases where the issuing authority is not a judge, a court, an investigating magistrate or a public prosecutor and where the measures necessary to execute the EEW would have to be ordered or supervised by a judge, a court, an investigating magistrate or a public prosecutor under the law of the executing State in a similar domestic case.

6. Lorsque les magistrats de liaison visés par l’action commune 96/277/JAI du Conseil du 22 avril 1996 concernant un cadre d’échange de magistrats de liaison visant à l’amélioration de la coopération judiciaire entre les États membres de l’Union européenne (5) ont été nommés dans un État membre et remplissent des fonctions analogues à celles confiées aux points de contact par l’article 4 de la présente décision, ils sont associés au Réseau judiciaire européen et ont accès aux télécommunications sécurisées en application de l’article 9, par les États membres qui les désignent, selon des modalités à définir par ces États.
6. Where the liaison magistrates referred to in Council Joint Action 96/277/JHA of 22 April 1996 concerning a framework for the exchange of liaison magistrates to improve judicial cooperation between the Member States of the European Union (5) have been appointed in a Member State and have duties analogous to those assigned by Article 4 of this Decision to the contact points, they shall be linked to the European Judicial Network and to the secure telecommunications connection pursuant to Article 9 of this Decision by the Member State appointing the liaison magistrate in each case, in accordance with the procedures to be laid down by that Member State.

Since 2004, at the European Parliament’s request the Commission has been operating a judicial exchanges scheme as a pilot project alongside the AGIS programme.
