Member States shall ensure that a parent institution in a Member State, a Union parent institution, or an entity referred to in point (c) or (d) of Article 1(1) and its subsidiaries in other Member States or third countries that are institutions or financial institutions covered by the consolidated supervision of the parent undertaking, may enter into an agreement to provide financial support to any other party to the agreement that meets the conditions for early intervention pursuant to Article 27, provided that the conditions laid down in this Chapter are also met.

In order to overcome potential legal impediments to providing financial support within a group of institutions, Member States shall ensure that a parent institution in a Member State, or a Union parent institution, or a company referred to in points (c) and (d) of Article 1and its subsidiaries in other Member States or third countries that are institutions or financial institutions covered by the supervision of the parent undertaking, shall establish arrangements, for the purposes of this Directive, setting out whether or not they have entered into an agreement to provide financial support to any other party in the group to the agreement that experiences financial difficulties, and demonstrating how the conditions laid down in this chapter are satisfied.

Si, en dépit des mesures ainsi prises par l'État membre d'origine ou parce que ces mesures apparaissent inadéquates ou font défaut dans cet État membre, l'établissement de crédit persiste à enfreindre les dispositions légales visées au paragraphe 1 qui sont en vigueur dans l'État membre d'accueil, ce dernier peut, après en avoir informé les autorités compétentes de l'État membre d'origine, prendre des mesures appropriées pour prévenir ou sanctionner de nouvelles infractions et, pour autant que cela soit nécessaire, empêcher cet établissement de crédit de commencer de nouvelles transactions sur son territoire.
4. If, despite the measures taken by the home Member State or because such measures prove inadequate or are not provided for in the Member State in question, the credit institution persists in violating the legal rules referred to in paragraph 1 in force in the host Member State, the latter may, after informing the competent authorities of the home Member State, take appropriate measures to prevent or to punish further breaches and, in so far as is necessary, to prevent that credit institution from initiating further transactions within its territory.
