(3) Subject to subsections (4) to (6), a retirement pension that becomes payable after December 31, 1986 and before January 1, 2011 commencing with a month other than the month in which the contributor reaches 65 years of age is a basic monthly amount equal to the basic monthly amount calculated in accordance with subsection (1) or (2), as the case may be, adjusted by a factor fixed by the Minister, on the advice of the Chief Actuary of the Office of the Superintendent of Financial Institutions, to reflect the time interval between the month in which the retirement pension commences and the month in which the contributor reached, or would reach, 65 years of age, but the time interval is deemed never to exceed five years.

The Commission has 65 working days following the notification of the concentration within which to decide whether to deal with case itself under this regulation or to refer the whole or part of the case to the competent authorities of the EU country; if the Commission fails to adopt a decision the case is considered to have been referred to the EU country in question.

5. Si, dans le délai de soixante-cinq jours ouvrables visé au paragraphe 4, point b), la Commission, en dépit d'un rappel de l'État membre concerné, n'a ni pris les décisions de renvoi ou de refus de renvoi prévues au paragraphe 3 ni entrepris les démarches préparatoires visées au paragraphe 4, point b), elle est réputée avoir décidé de renvoyer le cas à l'État membre concerné, conformément au paragraphe 3, point b).
5. If within the 65 working days referred to in paragraph 4(b) the Commission, despite a reminder from the Member State concerned, has not taken a decision on referral in accordance with paragraph 3 nor has taken the preparatory steps referred to in paragraph 4(b), it shall be deemed to have taken a decision to refer the case to the Member State concerned in accordance with paragraph 3(b).
