La croissance attendue du trafic ferroviaire conduira à une utilisation plus intensive de l’infrastructure ferroviaire et, ainsi, à une hausse des recettes pour les gestionnaires de l’infrastructure — notamment par les redevances d'utilisation de l'infrastructure ferroviaire ou les redevances liées aux services ferroviaires.
The expected growth in railway traffic will lead to an increased use of railway infrastructure, thus, generating more revenues for infrastructure managers - notably through infrastructure charges or charges for rail-related services.

Afin d'assurer une surveillance efficace du marché ferroviaire et une réglementation adéquate en ce qui concerne la perception de redevances d'utilisation de l'infrastructure et la répartition des capacités de l'infrastructure ferroviaire, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne quant aux critères et à la procédure devant servir de cadre à la surveillance du marché, quant à certains éléments du document de référence du réseau, à certains principes de tarification, à l'octroi d'une réduction temporaire de la redevance d'infrastructure pour les trains équipés du système européen de contrôle des trains (ETCS), à certains éléments du système d'amélioration des performances, aux critères à utiliser pour fixer les règles imposées aux candidats à l'obtention de capacités d'infrastructure, au calendrier du processus de répartition des capacités, aux comptes réglementaires et aux pratiques et principes décisionnels communs élaborés par les organismes de contrôle.
In order to ensure proper monitoring of the rail market and good regulation with regard to the levying of charges for the use of railway infrastructure and allocation of railway infrastructure capacity, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union (TFEU) should be delegated to the Commission in respect of the criteria and procedure to be followed as the scope of market monitoring, certain elements of the network statement, certain principles of charging, the temporary reduction for European Train Control System (ETCS), certain elements of the performance scheme, the criteria to be followed for the requirements with regard to applicants for infrastructure, the schedule for the allocation process, the regulatory accounts and common principles and practices for making decisions developed by regulatory bodies.

(9) In the road transport sector, tolls as distance based charges for the use of infrastructure constitute a fair and efficient economic instrument to achieve the objective of moving towards a sustainable transport policy, since they have a direct relationship with the use of infrastructure and can vary according to the distance travelled, the environmental performance of vehicles and the place and time of use of vehicles and therefore can be set at a level which reflects the cost of pollution and congestion caused by the actual use of vehicles.

(36) To enable the establishment of appropriate and fair levels of infrastructure charges, infrastructure managers need to record and establish the valuation of their assets and develop a clear understanding of cost factors in the operation of the infrastructure.

Member States shall lay down conditions, including where appropriate advance payments, to ensure that, under normal business conditions and over a reasonable time period, the accounts of an infrastructure manager shall at least balance income from infrastructure charges, surpluses from other commercial activities and State funding on the one hand, and infrastructure expenditure on the other.

(49) Conformément au principe de subsidiarité et au principe de proportionnalité tels qu'énoncés à l'article 5 du traité, les objectifs de la présente directive, à savoir la coordination des systèmes des États membres régissant la répartition des capacités d'infrastructure ferroviaire et la perception de redevances d'utilisation de ladite infrastructure ainsi que la délivrance des certificats de sécurité, ne peuvent pas être réalisés de manière suffisante par les États membres, compte tenu de la nécessité d'assurer des conditions équitables et non discriminatoires pour l'accès à l'infrastructure et de tenir compte de la dimension manifestement internationale du fonctionnement d'éléments importants des réseaux ferroviaires, et peuvent donc être mieux réalisés au niveau communautaire en raison de la nécessité d'une action transnationale coordonnée.
(49) In accordance with the principles of subsidiarity and proportionality as set out in Article 5 of the Treaty, the objectives of this Directive, namely to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof as well as safety certification, cannot be sufficiently achieved by the Member States in view of the need to ensure fair and non-discriminatory terms for access to the infrastructure as well as to take account of the manifestly international dimensions involved in the operation of significant elements of the railway networks, and can therefore, by reason of the need for coordinated trans-national action, be better achieved by the Community.
