La tâche de la Convention va en effet se concentrer sur l’introduction d’une habilitation de nature constitutionnelle dans le traité constitutionnel afin que l’Union puisse adhérer à la Convention européenne des droits de l’homme. Il incombera ensuite à l’Union de négocier concrètement l’adhésion avec le Conseil de l’Europe et de décider le moment de l’adhésion et ses modalités respectives, selon les procédures habituelles, sans remettre en cause les engagements individuels de chaque État membre par rapport à la Convention européenne des droits de l’homme et ses protocoles additionnels.
The task of the Convention is indeed going to focus on incorporating a constitutional provision into the Constitutional Treaty to enable the Union to negotiate accession in practical terms with the Council of Europe and to decide, in accordance with normal procedure, when accession should take place and under what conditions, without in any way undermining the individual commitments of each Member State to the European Convention on Human Rights and its additional protocols.
