Étant donné que l’objectif du présent règlement, à savoir instituer une Agence de l’Union européenne pour la sécurité des réseaux et de l’information en vue de contribuer à un niveau élevé de sécurité des réseaux et de l’information dans l’Union, et en vue de sensibiliser la société et de favoriser l’émergence et promouvoir, dans la société, une culture de la sécurité des réseaux et de l’information, dans l’intérêt des citoyens, des consommateurs, des entreprises et des organismes du secteur public de l’Union, contribuant ainsi à l’établissement et au bon fonctionnement du marché intérieur, ne peut pas être atteint de manière suffisante par les États membres et peut donc être mieux atteint au niveau de l’Union, celle-ci peut prendre des mesures conformément au principe de subsidiarité consacré à l’article 5 du traité sur l’Union européenne.
Since the objective of this Regulation, namely to establish a European Union Agency for Network and Information Security for the purpose of contributing to a high level of network and information security within the Union and in order to raise awareness and develop and promote a culture of network and information security in society for the benefit of citizens, consumers, enterprises and public sector organisations in the Union, thus contributing to the establishment and proper functioning of the internal market, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

Since the objectives of this Regulation, namely to ensure the effectiveness and efficiency of standards and standardisation as policy tools for the Union through cooperation between European standardisation organisations, national standardisation bodies, Member States and the Commission, the establishment of European standards and European standardisation deliverables for products and for services in support of Union legislation and policies, the identification of ICT technical specifications eligible for referencing, the financing of European standardisation and stakeholder participation in European standardisation cannot be sufficiently achieved by the Member States and can, therefore, by reason of their effect, be better achieved at the Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 TEU.

Since the objective of this Framework Decision, namely the mutual recognition of decisions on supervision measures in the course of criminal proceedings, cannot be sufficiently achieved by the Member States acting unilaterally and can therefore, by reason of its scale and effects, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 2 of the Treaty on European Union and Article 5 of the Treaty establishing the European Community.

Étant donné que l’objectif de la présente décision-cadre, à savoir faire en sorte que les infractions racistes et xénophobes soient à tout le moins passibles dans tous les États membres d’un niveau minimum de sanctions pénales effectives, proportionnées et dissuasives ne peut être réalisé de manière suffisante par les États membres agissant individuellement, les règles devant être communes et compatibles, et que cet objectif peut donc être mieux réalisé au niveau de l’Union européenne, l’Union européenne peut adopter des mesures conformément au principe de subsidiarité visé à l’article 2 du traité sur l’Union européenne et consacré à l’article 5 du traité instituant la Communauté européenne.
Since the objective of this Framework Decision, namely ensuring that racist and xenophobic offences are sanctioned in all Member States by at least a minimum level of effective, proportionate and dissuasive criminal penalties, cannot be sufficiently achieved by the Member States individually, since such rules have to be common and compatible and since this objective can therefore be better achieved at the level of the European Union, the Union may adopt measures, in accordance with the principle of subsidiarity as referred to in Article 2 of the Treaty on European Union and as set out in Article 5 of the Treaty establishing the European Community.
