L'article 167 du traité reconnaît l'importance de la promotion de la culture pour l'Union et ses États membres et prévoit que l'Union doit tenir compte des aspects culturels dans son action au titre d'autres dispositions du traité, afin notamment de respecter et de promouvoir la diversité de ses cultures.
Article 167 of the Treaty recognises the importance of promoting culture for the Union and its Member States and provides that the Union should take cultural aspects into account in its action under other provisions of the Treaty, in particular in order to respect and to promote the diversity of its cultures.

En vertu de l’article 167 du traité sur le fonctionnement de l’Union européenne, l’Union doit tenir compte de la diversité culturelle dans ses actions et contribuer à l’épanouissement des cultures des États membres dans le respect de leur diversité nationale et régionale, tout en mettant en évidence le patrimoine culturel commun.

It must be recalled that the Court stated, in its reasoning in the judgment in AM S Europe v Commission relating to legal professional privilege in investigation procedures in matters of competition law, that that area of European Union law must take into account the principles and concepts common to the laws of the Member States concerning the observance of confidentiality, in particular, as regards certain communications between lawyer and client (see paragraph 18 of that judgment).
