L’article 5, paragraphe 3, de la directive 1999/44 doit être interprété en ce sens qu’il doit être considéré comme une norme équivalente à une règle nationale qui occupe, au sein de l’ordre juridique interne, le rang de norme d’ordre public et que le juge national est tenu d’appliquer d’office toute disposition assurant sa transposition en droit interne.
Article 5(3) of Directive 1999/44 must be interpreted as meaning that it must be regarded as a provision of equal standing to a national rule which ranks, within the domestic legal system, as a rule of public policy and that the national court must of its own motion apply any provision which transposes it into domestic law.

(9) The European political parties and the European political foundations should be governed by the substantive rules set out in this Regulation, and by national law in the Member States, in particular that of the Member State where they have their respective seat and for the purposes of which they should identify the appropriate legal form, which must correspond to a form of legal entity recognised in the legal order of that Member State.

Le principe général est que l’ordre juridique polonais doit agir pour remédier à la différence de traitement. Cette tâche incombe, à mes yeux, au législateur polonais.
The general principle is that the Polish legal order must act to amend this difference in treatment and that, I believe, is a matter for the Polish legislator.

Le problème touche plutôt ce principe général. Toutefois, ce principe général ne permet pas à la Commission européenne de définir la manière dont l’ordre juridique polonais devrait modifier sa législation. En effet, comme il s’agit d’une question régie par le droit national, si la Pologne souhaite régir la perte du statut des députés nationaux de manière différente que la perte du statut des députés européens, c’est possible. Il faut simplement que les dispositions régissant une matière soient conformes aux dispositions régissant l’autre.
