La Cour de justice de l'UE a jugé, le 3 juillet 2008, entre autres, que l'Irlande avait omis de procéder à une évaluation des incidences sur l'environnement concernant l'installation d'un parc comptant 70 éoliennes - le plus important d'Irlande et, au moment du jugement, l'un des plus importants dans l'UE.
The Court of Justice of the EU ruled on 3 July 2008, amongst others, that Ireland had failed to carry out an environmental impact assessment for the 70 turbine wind farm – the largest in Ireland, and, at the time of judgment, one of the largest in the EU.

As regards the pass-on of increased production costs to final customers and potential sales reductions, the United Kingdom had provided information showing that, following the introduction of the levy in 2002, the average price of aggregate in Northern Ireland had increased by much less than would have been expected if the AGL had been passed on in full, and that this was linked to a fall in legitimate sales, which was proportionally much larger than the fall recorded in Great Britain.

The United Kingdom had also explained that once the levy had been introduced at GBP/tonne 1,60, the average price of aggregates in Northern Ireland had risen by about GBP 0,25-0,30/tonne in 2002 compared with 2001, whereas in Great Britain the price had risen by GBP/tonne 1-1,40.

The Commission nevertheless pointed out that the United Kingdom had not provided sufficiently detailed data demonstrating and quantifying the impact on those arguments of the fact that the manufacturers of processed products from aggregates had never paid the full AGL as its introduction in the Northern Ireland had been phased.
