Le Royaume-Uni participe au présent [acte], conformément à l’article 5, paragraphe 1, du protocole n° 19 sur l’acquis de Schengen intégré dans le cadre de l’Union européenne, annexé au traité sur l'Union européenne et au traité sur le fonctionnement de l'Union européenne, et conformément à l’article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord de participer à certaines dispositions de l’acquis de Schengen*.
The United Kingdom is taking part in this [INSTRUMENT], in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*.

Une part essentielle du respect de l’application des règles de l’acquis de Schengen, qui font partie du droit européen, est le mécanisme d’évaluation, qui devrait garantir la mise en œuvre transparente, efficace et cohérente de l’acquis de Schengen, mais aussi refléter les changements apportés à la situation législative qui a vu le jour après l’intégration de l’acquis de Schengen dans le cadre communautaire.
An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.

En outre, s’il est certes nécessaire de tirer les conséquences de l’intégration de l’acquis de Schengen dans le droit communautaire et dans le droit de l’Union, il ne faut pas pour autant confier la gestion de cette évaluation à seule la Commission.
Moreover, while conclusions must certainly be drawn from the integration of the Schengen acquis into Community law and into EU law, this does not mean that the management of this evaluation should be entrusted to the Commission alone.

L'objectif est également de répondre à l'évolution de la situation juridique après l'intégration de l'acquis de Schengen dans le cadre de l'Union, avec l'attribution d'une base juridique pour chaque disposition de l'acquis dans le cadre des premier et troisième piliers.
The proposal further aims to respond to the changes in the legal situation following the integration of the Schengen acquis into the EU framework, when each provision of the acquis received a legal basis under the first or the third pillar.

On 20 May 1999 the Council adopted two decisions on the measures needed for integration of the Schengen acquis into the framework of the European Union. The first set out which provisions of the acquis need to be integrated (all binding provisions except those which are no longer operative, in particular those superseded by European Union procedures); the second allocates those provisions between the Union's first "pillar" (the Treaty establishing the European Community) and its third (police cooperation and judicial cooperation in criminal matters between governments).
