L’institution reconnue comme compétente pour le versement des prestations retient le montant dû au titre du paiement provisoire sur les arriérés des prestations correspondantes qu’elle doit à la personne concernée et transfère sans délai le montant retenu à l’institution ayant versé les prestations en espèces à titre provisoire.
The institution identified as being competent for paying the benefits shall deduct the amount due in respect of the provisional payment from the arrears of the corresponding benefits it owes to the person concerned and shall without delay transfer the amount deducted to the institution which provisionally paid the cash benefits.

À la demande de l’institution reconnue comme compétente, introduite au plus tard trois mois après avoir établi quelle est la législation applicable, l’institution ayant perçu des cotisations à titre provisoire les transfère à l’institution reconnue comme compétente pour la période correspondante en vue de régler la situation relative aux cotisations dues par une personne physique et/ou morale.
Upon request of the institution identified as being competent, which shall be made at the latest three months after the applicable legislation has been determined, the institution that has provisionally received contributions shall transfer them to the institution identified as being competent for that period for the purpose of settling the situation concerning the contributions owed by the legal and/or natural person to it.

1. Aux fins de l’application de l’article 6 du règlement d’application, trois mois au plus tard après avoir déterminé quelle est la législation applicable ou l’institution débitrice des prestations, l’institution ayant versé des prestations en espèces à titre provisoire établit un décompte du montant versé à titre provisoire et l’adresse à l’institution reconnue comme compétente.
1. For the purposes of applying Article 6 of the implementing Regulation, at the latest three months after the applicable legislation has been determined or the institution responsible for paying the benefits has been identified, the institution which provisionally paid the cash benefits shall draw up a statement of the amount provisionally paid and shall send it to the institution identified as being competent.

4. Lorsqu’il est établi que la législation applicable n’est pas celle de l’État membre dans lequel l’affiliation provisoire a eu lieu ou que l’institution qui a servi les prestations à titre provisoire n’était pas l’institution compétente, l’institution reconnue comme compétente est réputée l’être rétroactivement, comme si cette divergence de vues n’avait pas existé, au plus tard à partir de la date de l’affiliation provisoire ou du premier octroi à titre provisoire des prestations en cause.
4. Where it is established either that the applicable legislation is not that of the Member State of provisional membership, or the institution which granted the benefits on a provisional basis was not the competent institution, the institution identified as being competent shall be deemed retroactively to have been so, as if that difference of views had not existed, at the latest from either the date of provisional membership or of the first provisional granting of the benefits concerned.

5. Si nécessaire, l’institution reconnue comme compétente et l’institution ayant versé des prestations en espèces à titre provisoire ou ayant perçu des cotisations à titre provisoire règlent la situation financière de la personne concernée au regard des cotisations et des prestations en espèces versées à titre provisoire, le cas échéant en conformité avec le titre IV, chapitre III, du règlement d’application.
5. If necessary, the institution identified as being competent and the institution which provisionally paid the cash benefits or provisionally received contributions shall settle the financial situation of the person concerned as regards contributions and cash benefits paid provisionally, where appropriate, in accordance with Title IV, Chapter III, of the implementing Regulation.

(E) in any other case, activities engaged in by the person in the course of operating a recognized degree-granting institution, a college affiliated with, or research body of, such an institution, an elementary or secondary school or a post-secondary college or technical institute, as the case may be, and
