2. Where, under the legislation of the Member State which is competent under Title II of the basic Regulation, no child-raising period is taken into account, the institution of the Member State whose legislation, according to Title II of the basic Regulation, was applicable to the person concerned on the grounds that he or she was pursuing an activity as an employed or self-employed person at the date when, under that legislation, the child-raising period started to be taken into account for the child concerned, shall remain responsible for taking into account that period as a child-raising period under its own legislation, as if such child-raising took place in its own territory.

2. L’institution compétente de l’État membre dont la législation devient applicable à une personne en vertu du titre II du règlement de base met à la disposition de l’institution désignée par l’autorité compétente de l’État membre à la législation duquel la personne était soumise en dernier lieu les informations indiquant la date à laquelle l’application de cette législation prend effet.
2. The competent institution of the Member State whose legislation becomes applicable to a person pursuant to Title II of the basic Regulation shall make the information indicating the date on which the application of that legislation takes effect available to the institution designated by the competent authority of the Member State to whose legislation that person was last subject.

2. Aux fins de l’application de l’article 62, paragraphe 3, du règlement de base, l’institution compétente de l’État membre à la législation duquel la personne concernée était soumise au cours de sa dernière activité salariée ou non salariée communique sans délai à l’institution du lieu de résidence, à la demande de celle-ci, tous les éléments nécessaires au calcul des prestations de chômage qui peut être obtenue dans l’État membre de résidence, notamment le montant du salaire ou du revenu professionnel perçu.
2. For the purposes of applying Article 62(3) of the basic Regulation, the competent institution of the Member State to whose legislation the person concerned was subject in respect of his last activity as an employed or self-employed person shall, without delay, at the request of the institution of the place of residence, provide it with all the information necessary to calculate unemployment benefits which can be obtained in the Member State of residence, in particular the salary or professional income received.

4. Lorsqu’il est établi que la législation applicable n’est pas celle de l’État membre dans lequel l’affiliation provisoire a eu lieu ou que l’institution qui a servi les prestations à titre provisoire n’était pas l’institution compétente, l’institution reconnue comme compétente est réputée l’être rétroactivement, comme si cette divergence de vues n’avait pas existé, au plus tard à partir de la date de l’affiliation provisoire ou du premier octroi à titre provisoire des prestations en cause.
4. Where it is established either that the applicable legislation is not that of the Member State of provisional membership, or the institution which granted the benefits on a provisional basis was not the competent institution, the institution identified as being competent shall be deemed retroactively to have been so, as if that difference of views had not existed, at the latest from either the date of provisional membership or of the first provisional granting of the benefits concerned.

If a member institution formed by an amalgamation involving only one member institution has been operating as a member institution for less than three fiscal years consisting of at least 12 months each (with the third fiscal year ending in the year preceding the filing year), in addition to filling in the applicable elements as an amalgamated member institution, it must also fill in the applicable elements for the amalgamating member institution.

If a member institution formed by an amalgamation involving only one member institution has been operating as a member institution for less than four fiscal years consisting of at least 12 months each (with the fourth fiscal year ending in the year preceding the filing year), in addition to filling in the applicable elements as an amalgamated member institution, it must also fill in the applicable elements for the amalgamating member institution.

2. La personne qui a été victime d'un accident du travail ou qui a contracté une maladie professionnelle, et qui réside ou séjourne dans un État membre autre que l'État membre compétent, bénéficie des prestations en nature particulières du régime des accidents du travail et des maladies professionnelles servies, pour le compte de l'institution compétente, par l'institution du lieu de résidence ou de séjour conformément à la législation qu'elle applique, comme si elle était assurée en vertu de cette législation.
2. A person who has sustained an accident at work or has contracted an occupational disease and who resides or stays in a Member State other than the competent Member State shall be entitled to the special benefits in kind of the scheme covering accidents at work and occupational diseases provided, on behalf of the competent institution, by the institution of the place of residence or stay in accordance with the legislation which it applies, as though he/she were insured under the said legislation.
