IN-CONTEXT TRANSLATIONS

Afin d’assurer l’uniformité des modalités de mise en œuvre du présent règlement et des actes délégués adoptés en vertu du présent règlement, il y a lieu de conférer à la Commission des compétences d’exécution pour l’adoption, selon les conditions et les critères énoncés dans les actes délégués, des mesures spécifiquement applicables aux restrictions d’accès aux informations produites par les services GMES et aux données recueillies via l’infrastructure GMES spécifique, notamment des mesures individuelles tenant compte du degré de sensibilité des informations et des données en question.
In order to ensure uniform conditions for implementation of this Regulation and of the delegated acts adopted on the basis of this Regulation, implementing powers should be conferred on the Commission to adopt, on the basis of the conditions and criteria established by delegated acts, specific measures on restricting access to the information produced by the GMES services and to data collected through the GMES dedicated infrastructure, including individual measures taking into account the sensitivity of the information and data in question.

(4 quinquies) En vue de fournir un cadre garantissant un accès libre et sans restriction aux informations produites par les services GMES et aux données recueillies via l'infrastructure GMES, tout en assurant l'indispensable protection des informations produites par les services GMES et des données recueillies via l'infrastructure GMES spécifique, il y a lieu d'habiliter la Commission à adopter des actes délégués conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne pour la définition des conditions d'immatriculation et d'autorisation des utilisateurs GMES et des critères applicables à la limitation de l'accès aux données et aux informations GMES, compte tenu des politiques suivies par les fournisseurs des données et des informations dont le programme GMES a besoin, et sans préjudice des règles et des procédures nationales applicables aux infrastructures spatiales et terrestres sous contrôle national.
(4d) For the purpose of providing for a framework ensuring full and open access to information produced by GMES services and data collected through GMES infrastructure, while providing for the necessary protection of the information produced by the GMES services and of data collected through the GMES dedicated infrastructure, the Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union in respect of registration and licensing conditions for GMES users and of criteria for restriction of access to GMES data and information, while taking into account the data and information policies of providers of data needed for GMES, and without prejudice to national rules and procedures applicable to space and in situ infrastructures under national control.

2. En vue de fournir un cadre propre à garantir la réalisation de l’objectif d'une politique d'accès aux informations et aux données GMES visé au paragraphe 1, point b), tout en assurant l'indispensable protection des informations produites par les services GMES et des données collectées via l’infrastructure GMES spécifique, la Commission peut adopter, par voie d'actes délégués en vertu de l'article 8 bis et sous réserve des conditions énoncées aux articles 8 ter et 8 quater, les mesures suivantes, compte tenu des politiques suivies par les fournisseurs des données et des informations dont le programme GMES a besoin, et sans préjudice des règles et des procédures nationales applicables aux infrastructures spatiales et terrestres sous contrôle national:

For the purpose of providing for a framework ensuring the attainment of the GMES information and data policy objective referred to in point (b) of paragraph 1 while providing for the necessary protection of the information produced by the GMES services and of data collected through the GMES dedicated infrastructure, the Commission may adopt, by means of delegated acts in accordance with Article 8a and subject to the conditions of Articles 8b and 8c, the following measures, taking into account the data and information policies of providers of data needed for GMES, and without prejudice to national rules and procedures applicable to space and in situ infrastructures under national control:

Sur la base des critères visés à l'article 8, paragraphe 2, point b ), la Commission adopte des mesures spécifiques en conformité avec la procédure de réglementation visée à l'article 11, paragraphe 2, sur la limitation de l'accès aux informations produites par les services GMES et aux données recueillies via l'infrastructure GMES spécifique.

On the basis of the criteria referred to in point (b) of Article 8(2), the Commission shall adopt specific measures in accordance with the regulatory procedure referred to in Article 11(2), on restricting access to the information produced by GMES services and data collected through the GMES dedicated infrastructure.

The continuous availability of the underlying in-situ and space observation infrastructure needs to be ensured, including space infrastructure specifically developed for GMES within the framework of the ESA GMES space component programme (the ‘Sentinels’).

Welcomes the EEA strategy 2004 – 2008, and objectives contained therein. Recognises the policy priorities set out as those central to the Community’s Environment Policy Agenda, identified and set out in the 6 Environmental Action Programme. Calls on the Agency to strengthen the European Environment Information and Observation Network (EIONET) as a key operating infrastructure. Calls on the Agency to work with the Commission and Member States to streamline data reporting and recognise the role of EIONET in achieving this aim. Agrees with the Commission view that a specific Community objective should be to step up the development of a shared European information system for the environment, which would go beyond the EEA's own data sources and includes reporting obligations under Community law and under various multilateral environmental agreements. Calls on the Agency to continue to contribute to the Commission-led review of reporting and develop its information system in line with the Inspire (Infrastructure for Spatial Information in Europe) and Global Monitoring for Environment and Security (GMES) initiatives. Welcomes the Agency’s ongoing cooperation with WHO, UNEP, UNECE, OECD and several other international bodies. Envisages, on the basis of a proposal by the Commission, a review of the Council Regulation on the establishment of the EEA towards the end of the current Multiannual Work Programme of the Agency (EEA Strategy 2004-2008)".
