Calls on all countries in the region to act swiftly to tackle the persistent reports of alleged arbitrary arrests, ill-treatment and abuses, in spite of legislation prohibiting such practices; expresses particular concern over the reports of torture in detention centres and the arbitrary arrests of thousands of migrants in Mauritania, as well as the authorities’ refusal after two years to communicate the whereabouts of certain convicted prisoners to their families; expresses alarm also at reports in Chad of mass ill-treatment in detention, detention without trial, and hundreds of forced evictions in N’Djamena, in addition to the forced disappearance of prisoners; points out that forced disappearances are considered a war crime under the Rome Statute; condemns the reports of extremely poor conditions in some of the region’s prisons, particularly in Chad and Mali, which lack basic healthcare and inflict great suffering on inmates; calls on the Sahel countries to improve living conditions for prisoners and, in particular, to guarantee the safety and security of the most vulnerable groups, such as women and children; draws attention, moreover, to the recent death sentences imposed by the Malian judiciary for crimes including robbery, criminal association and the illegal possession of firearms;

Question No. 204 Ms. Dawn Black: With regard to detainee handling in Afghanistan: (a) at what time was Canada first granted formal access to Afghan monitor detention facilities in Kandahar; (b) how many Correctional Service of Canada (CSC) officers were in Kandahar in August 2005, and what was the number for each month since; (c) did CSC direct their officers to specifically monitor detainees taken by Canadians and held in Afghan custody, and, if so, what form did that direction take; (d) what type of investigation was begun by the Department of National Defence and the Canadian Forces following the publishing of reports of torture in the Globe and Mail on Monday, April 23, 2007, and when was it commenced; (e) what is the number of detainees transferred to Afghan custody since the signing of the December 18, 2005, “Arrangement for the Transfer of Detainees Between the Canadian Forces and the Ministry of Defence of the Islamic Republic of Afghanistan”; (f) following the processing of transfer documents and the release of a detainee to Afghan authorities, how are National Defence Headquarters, the Chief of the Defence Staff (CDS) and the Minister of National Defence informed of this transfer respectively; (g) when was information about the Department of Foreign Affairs country reports, starting in 2002, describing torture and inhumane treatment in Afghan prisons as “common”, first released outside of the Department and when were i) the current and previous Foreign Affairs Ministers made aware, ii) the current and previous Defence Ministers made aware, iii) the current and previous Prime Ministers made aware; (h) when were negotiations begun on the arrangement for monitoring access announced by the Minister of National Defence on Wednesday April 25, 2007, and i) when were negotiations concluded, ii) when was the CDS made aware of the arrangement, iii) when was the Minister of Foreign Affairs made aware of the arrangement, iv) when was the Prime Minister made awa ...

When transmitting information pursuant to Article 4, the central authority of the convicting Member State may inform the central authority of the Member State of the person's nationality that the information on convictions handed down in the former and transmitted to the latter may be transmitted to the central authority of another Member State requesting it only with the consent of the convicting Member State.

6. Each Member State shall take the necessary measures to ensure that any relevant information included in document, file, item of information, object or other means of evidence, seized or confiscated in the course of criminal investigations or criminal proceedings in connection with terrorist offences can be made accessible or available immediately to the authorities of other interested Member States in accordance with national law and relevant international legal instruments where investigations are being carried out or might be initiated, or prosecutions are in progress in connection with terrorist offences; Member States receiving such information shall undertake to protect it in accordance with the same standards of confidentiality as those applied by the originating state and to notify the originating state forthwith of related information in their possession.
