L’octroi d’une aide donne certes un avantage économique à la société minière HPB, mais la Commission est arrivée à la conclusion que la mesure proposée respectait les dispositions du règlement du Conseil concernant les aides d’État à l’industrie houillère , puisque l’aide n’excédait pas 30 % du coût d’investissement prévu, et qu’elle était dès lors compatible avec le bon fonctionnement du marché commun.
The payment gives an economic advantage to the mining company HPB. However, the Commission has come to the conclusion that the proposed aid measure respects the provisions of the Council Regulation on State aid to the coal industry as it does not exceed 30% of the foreseen investment costs, and that it is therefore compatible with the proper functioning of the common market.

_ftn1#_ftn1Cependant, la Commission est arrivée à la conclusion que cette mesure d'aide respecte les dispositions du règlement du Conseil concernant les aides d'État à l’industrie houillère[1] puisqu’elle couvre le coût des charges héritées du passé de la compagnie minière et que, par conséquent, elle est compatible avec les exigences de bon fonctionnement du marché commun.
However, the Commission has come to the conclusion that the proposed aid measure respects the provisions of the Council Regulation on State aid to the coal industry[1] as it covers the cost of inherited liabilities of the mining company, and that it therefore is compatible with the proper functioning of the common market.

En effet, "si l'on observe une certaine baisse des coûts de production moyens de l'industrie houillère allemande et compte tenu de l'article 3, paragraphe 3, de la décision n° 3632/93/CECA, ces derniers, exprimés à prix constants de 1992, resteront élevés puisque par rapport à 288 marks allemands par tec en 1992, ils se situeraient encore à 242 marks allemands en 2002".
Indeed, "even if the average production costs in the German coal industry have fallen slightly, taking account of Article 3(3) of Decision No 3632/93/ECSC, the production costs, expressed at 1992 constant prices, are still too high as they should be DEM 242 per tce in 2002 as compared with DEM 288 per tce in 1992".
