1. Pour les besoins du présent règlement, le terme «préjudice» s'entend, sauf indication contraire, d'un préjudice important causé à une industrie communautaire, d'une menace de préjudice important pour une industrie communautaire ou d'un retard sensible dans la création d'une industrie communautaire et est interprété conformément aux dispositions du présent article.

Pursuant to this Regulation, the term ‘injury’ shall, unless otherwise specified, be taken to mean material injury to the Community industry, threat of material injury to the Community industry or material retardation of the establishment of such an industry and shall be interpreted in accordance with the provisions of this Article.

Lorsqu'une plainte est présentée par écrit au nom de l'industrie communautaire, elle précise l'industrie au nom de laquelle elle est présentée en donnant une liste de tous les producteurs communautaires connus du produit similaire (ou des associations de producteurs communautaires du produit similaire) et, dans la mesure du possible, une description du volume et de la valeur de la production communautaire du produit similaire que représentent ces producteurs.
Where a written complaint is made on behalf of the Community industry, the complaint shall identify the industry on behalf of which the complaint is made by a list of all known Community producers of the like product (or associations of Community producers of the like product) and, to the extent possible, a description of the volume and value of Community production of the like product accounted for by such producers.

La plainte est réputée avoir été déposée par l’industrie communautaire ou en son nom si elle est soutenue par des producteurs communautaires dont les productions additionnées constituent plus de 50 % de la production totale du produit similaire par la partie de l’industrie communautaire exprimant son soutien ou son opposition à la plainte.
The complaint shall be considered to have been made by or on behalf of the Community industry if it is supported by those Community producers whose collective output constitutes more than 50 % of the total production of the like product produced by that portion of the Community industry expressing either support for or opposition to the complaint.

À la suite de l’institution des mesures provisoires, un producteur-exportateur a contesté la situation préjudiciable de l’industrie communautaire en faisant valoir que les capacités de production de cette industrie avaient augmenté au cours de la période considérée, que l’évolution des stocks après 2001 ne devait pas être interprétée comme le signe d’un préjudice, mais comme le signe d’une amélioration de la situation de l’industrie communautaire, que les prix des transpalettes à main vendus par les producteurs communautaires et la part de marché de ces derniers étaient restés stables en 2003 et au cours de la période d’enquête, que l’industrie communautaire avait vu sa rentabilité progresser entre 2000 et 2001, que le niveau des investissements de l’industrie communautaire avait plus que doublé, ce qui indique que celle-ci n’a eu aucun mal à mobiliser des capitaux et que la stabilité des salaires doit être considérée comme un indicateur positif.
Following the imposition of the provisional measures, one exporting producer questioned the injurious situation of the Community industry by pointing out that the production capacity of the Community industry has increased during the period considered, the development of stocks after 2001 cannot be regarded as a sign of injury but a sign of improvement of the Community industry, the sales price of the hand pallet trucks sold by the Community producers and their market share remained stable in 2003 and during the IP, the profitability of the Community industry increased between 2000 and 2001, the level of investments of the Community industry has more than doubled indicating that it had no problem to raise capital and the stability of wages must be perceived as a positive indicator.

Compte tenu du fait que les prix des importations en provenance de Croatie et d'Ukraine ont été sensiblement inférieurs à ceux de l'industrie communautaire, rien n'indique que les importations susmentionnées qui, pour la plupart ont entraîné une sous-cotation moindre des prix de l'industrie communautaire, pourraient briser le lien de causalité entre les importations faisant l'objet d'un dumping en provenance de Croatie et d'Ukraine et le préjudice important subi par l'industrie communautaire.
Having regard to the fact that imports from Croatia and Ukraine undercut substantially the Community industry prices, there is no indication that the abovementioned imports, which in the majority undercut the Community prices to a lesser extent, could break the causal link between the dumped imports from Croatia and Ukraine and the material injury suffered by the Community industry.
