À cet effet, il a été considéré qu'une marge bénéficiaire de 15 % sur le chiffre d'affaires pouvait être celle que l'industrie communautaire aurait pu escompter en l'absence de dumping préjudiciable, compte tenu des résultats réalisés au cours de la première partie de la période considérée (2004, 2005 et 2006); cette marge a été jugée suffisante pour garantir à long terme les investissements productifs de cette nouvelle industrie.
For this purpose a profit margin of 15 % on turnover could be regarded as an appropriate level which the Community industry could have expected to obtain in the absence of injurious dumping based on the performance of the Community industry over the first part of the period considered (2004, 2005 and 2006) and deemed reasonable for guaranteeing the productive investment on a long-term basis for this newly established industry.

L'ensemble de ces facteurs aurait ainsi provoqué un préjudice important à l'industrie communautaire : niveaux de vente insuffisants pour couvrir les coûts, pertes financières pour certaines entreprises, sous-utilisation des capacités de production, des augmentations de stocks et des retards d'investissement.

According to EACEM, the Japanese firm's share of the market has gone up by more than 3% p.a. since 1983, reaching 9.5% in 1986, while the complainants' share of the market stayed at around 25% between 1984 and 1986. EACEM thinks that the alleged dumping has caused the Community industry to lose out during a period of recovery, a potentially serious threat to that industry in the future because of the negative effect it has on the investments, employment and profitability of this industry.
