Rendre l’identification électronique obligatoire dans l’Union pourrait avoir des répercussions économiques néfastes sur certains opérateurs.

3. Lorsque l’exploitation de destination est située dans un État membre ayant, en vertu de l’article 4, paragraphe 4, deuxième alinéa, rendu le recours à un dispositif d’identification électronique obligatoire au moyen de dispositions nationales, les animaux sont identifiés au moyen dudit dispositif d’identification électronique dans l’exploitation de destination dans l’Union, dans un délai à fixer par l’État membre de destination.
3. Where the holding of destination is situated in a Member State that has introduced national provisions under the second subparagraph of Article 4(4) to make the use of an electronic identifier compulsory, the animals shall be identified with that electronic identifier in the holding of destination in the Union, within a period to be determined by the Member State of destination.

Dans le cadre des échanges d’animaux à l’intérieur de l’Union, l’obligation d’identifier électroniquement les bovins devrait incomber à l’État membre ayant rendu le recours à l’identification électronique obligatoire sur son territoire.
During intra-Union animal trade movements the obligation to electronically identify a bovine animal should fall to the Member State which has made the use of EID compulsory on its territory.

Lorsque l’exploitation de destination est située dans un État membre ayant, au moyen de dispositions nationales, rendu le recours à un dispositif d’identification électronique obligatoire, les animaux sont identifiés au moyen dudit dispositif au plus tard dans l’exploitation de destination, dans un délai maximal à fixer par l’État membre dans lequel l’exploitation de destination est située.
2. Where the holding of destination is situated in a Member State that has introduced national provisions to make the use of an electronic identifier compulsory, the animals shall be identified with that electronic identifier at the latest in the holding of destination within a maximum period to be determined by the Member State where that holding of destination is located.

Dès lors, il y a lieu que les États membres soient autorisés à ne rendre l’identification électronique obligatoire sur leur territoire que lorsqu’ils l’estiment approprié, après avoir pris en compte l’ensemble de ces facteurs, y compris les incidences sur les petits exploitants, et après avoir consulté les organisations représentatives de la filière bovine.
Member States should therefore be allowed to make EID compulsory on their territory only when they deem it appropriate, after considering all of those factors, including impacts on small farmers, and following consultation with organisations representing the cattle industry.

+ for the electronic identification provisions, the Commission shall submit to the European Parliament and the Council the corresponding reports dealing with the implementation and impact of this Regulation including, in the first case, the possibility of reviewing the voluntary labelling provisions, and, in the second case, the technical and economic feasibility of introducing mandatory electronic identification throughout the Union.

Par conséquent, cinq années au plus tard après l'entrée en vigueur du présent règlement dans le cas des dispositions concernant l'étiquetage facultatif de la viande bovine, et neuf années dans le cas des dispositions relatives à l'identification électronique, la Commission devrait présenter au Parlement européen et au Conseil deux rapports traitant de la mise en œuvre du présent règlement et de la faisabilité technique et économique de l'instauration de l'identification électronique obligatoire partout dans l'Union.
Consequently, no later than five years after the entry into force of this Regulation as regards the provisions concerning voluntary beef labelling, and nine years as regards the provisions concerning EID, the Commission should submit to the European Parliament and to the Council two reports dealing both with the implementation of this Regulation and with the technical and economic feasibility of introducing mandatory EID everywhere in the Union.

(7) Bien que les systèmes d'identification électronique par radiofréquence se soient considérablement améliorés ces dix dernières années, l'expérience acquise dans la mise en œuvre de l'identification électronique obligatoire pour les petits ruminants montre qu'en raison de défaillances techniques et de difficultés d'ordre pratique, il est fréquemment impossible d'obtenir une précision de 100 %.
(7) Although electronic identification systems based on radio frequency identification have improved in the last ten years, experience of implementing mandatory electronic identification for small ruminants demonstrates that due to faulty technology and practical difficulties it is frequently impossible to achieve 100 % accuracy.
