À titre surabondant, le Tribunal estime que l’EPSO n’était pas tenu, afin de s’acquitter de son obligation de motivation, de communiquer au requérant la version corrigée de sa copie, les raisons pour lesquelles ses réponses étaient erronées, les grilles d’évaluation utilisées pour les épreuves écrites et orales, de tels documents faisant partie intégrante des appréciations de nature comparative auxquelles se livre le jury de concours et étant couverts par le secret des travaux de celui-ci.
For the sake of completeness, the Tribunal considers that EPSO was not required, in order to comply with its obligation to state reasons, to transmit to the applicant the marked version of his papers, the reasons why his answers were incorrect, and the assessment sheets used for the written and oral tests, since those documents formed an integral part of the assessments of a comparative nature which the competition selection board makes and are covered by the secrecy surrounding the board’s proceedings.

Par conséquent, ce volet de la note du 28 juillet 2009 ne remplit pas les conditions minimales exigées par la jurisprudence rappelée plus haut pour être considéré comme une réclamation au sens de l’article 90, paragraphe 2, du statut et l’EPSO n’était pas en mesure d’y apporter une réponse motivée.
Consequently, that part of the note of 28 July 2009 does not fulfil the minimum conditions required by the case-law cited above in order to be regarded as a complaint within the meaning of Article 90(2) of the Staff Regulations, and EPSO was not in a position to provide a reasoned response to it.

En l’espèce, s’il résulte des motifs et des conclusions ci-dessus énoncés que la requérante est la partie qui succombe et que la Commission a conclu à sa condamnation aux dépens, il en ressort également que, alors que la requérante avait demandé à plusieurs reprises la communication d’informations la concernant, relatives à ses épreuves écrites b) et c), en suivant la procédure établie au titre D, point 4, de l’avis de concours, et avait reçu plusieurs communications de l’EPSO d’après lesquelles la documentation demandée y était annexée, l’EPSO n’a fait droit à la demande de communication d’informations que le 16 juin 2010, à savoir alors que la requérante avait déjà introduit sa requête.
In the present case, although it is clear from the pleas and forms of order set out above that the applicant is the unsuccessful party and that the Commission has applied for her to be ordered to bear the costs, it is also apparent that although the applicant had asked on several occasions for information about her, concerning her written tests (b) and (c), following the procedure laid down in Section D.4 of the notice of competition, and had received several communications from EPSO stating that the documents requested were attached to them, EPSO did not grant the request for information until 16 June 2010, that is to say, when the applicant had already lodged her application.

Dès lors, la décision du jury du concours selon laquelle la requérante n’était pas admise à l’épreuve orale, adoptée à la suite de la demande de réexamen introduite par la requérante le 10 juillet 2009 et communiquée par lettre de l’EPSO du 23 juillet 2009, s’est substituée à la décision initiale du jury, communiquée par lettre de l’EPSO du 2 juillet 2009, et constitue en l’espèce l’acte faisant grief en ce qui concerne la non-admission de la requérante à participer à l’épreuve orale du concours (ci-après la « décision de non-admission à l’épreuve orale »).
Therefore, the selection board’s decision not to admit the applicant to the oral test, adopted following the request for review lodged by the applicant on 10 July 2009 and notified by letter from EPSO of 23 July 2009, replaced the board’s original decision, notified by letter from EPSO of 2 July 2009, and constitutes in the present case the act adversely affecting her so far as non-admission of the applicant to the oral test of the competition (‘the decision not to admit the applicant to the oral test’) is concerned.
