The United Kingdom is taking part in this [INSTRUMENT], in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*.

Les Hautes Parties Contractantes conviennent que le Conseil européen, en application de l'article 355, paragraphe 6, prendra une décision aboutissant à la modification du statut de Mayotte à l'égard de l'Union, de manière à ce que ce territoire devienne une région ultrapériphérique au sens de l'article 355, paragraphe 1, et de l'article 349, lorsque les autorités françaises notifieront au Conseil européen et à la Commission que l'évolution en cours du statut interne de l'île le permet.
The High Contracting Parties agree that the European Council, pursuant to Article 355(6), will take a decision leading to the modification of the status of Mayotte with regard to the Union in order to make this territory an outermost region within the meaning of Article 355(1) and Article 349, when the French authorities notify the European Council and the Commission that the evolution currently under way in the internal status of the island so allows.

Par ailleurs, il convient de relever qu'en vertu de l'article 355, paragraphe 6, du TFUE, le Conseil européen peut modifier le statut d'un pays et territoire d'outre-mer pour ce qui relève de l'application des traités audit pays et territoire d'outre-mer, mais que le libellé exact des traités ne peut être modifié qu'au travers des procédures visées à l'article 48 du traité UE. Dès lors, la légitimité de décisions du Conseil européen modifiant la formulation des traités peut être mise en question, en particulier au regard de l'article 13, paragraphe 2, du TFUE, qui dispose que chaque institution agit dans les limites des attributions qui lui sont conférées par le présent traité.
It should furthermore be noted that under Article 355(6) TFEU, the European Council may amend the status of an overseas country or territory as regards the application of the Treaties to that overseas country or territory, but the actual wording of the Treaties may only be amended by using the procedures in Article 48 TEU. The appropriateness of the European Council adopting decisions amending the wording of the Treaties can therefore be questioned, in particular taking into account Article 13(2) TFEU whereby each institution is to act within the limits of the powers conferred upon it by the Treaty.

Article 355(6) of the Treaty on the Functioning of the European Union (TFEU) allows the European Council, on the initiative of the Member State concerned and acting unanimously after consulting the Commission, to adopt a decision amending the status, with regard to the Union, of a Danish, French or Netherlands country or territory referred to in paragraphs 1 and 2 of Article 355.

Par lettre de son président en date du 26 octobre 2011, la République française (ci-après dénommée la «France») a demandé au Conseil européen de prendre une telle décision afin que Mayotte, qui a actuellement le statut de pays et territoire d’outre mer au sens de l’article 355, paragraphe 2, du TFUE et qui figure à ce titre à l’annexe II dudit traité, accède au statut de région ultrapériphérique, au sens de l’article 349 du TFUE.
In a letter from the French President dated 26 October 2011, the French Republic (hereinafter ‘France’) asked the European Council to take such a decision to enable Mayotte, which currently has the status of an overseas country or territory within the meaning of Article 355(2) TFEU and is listed as such in Annex II to the Treaty, to acquire the status of an outermost region within the meaning of Article 349 TFEU.

Une référence à Mayotte devrait donc être insérée audit article pour que celui-ci lui soit applicable dans son ensemble, ainsi qu’à l’article 355, paragraphe 1, du TFUE.
References to Mayotte should therefore be inserted into Article 349, making the whole of that Article applicable to Mayotte, and into Article 355(1) TFEU.
