IN-CONTEXT TRANSLATIONS

Les modifications concernant la forme et la réutilisation de l'aide remboursable, ainsi que l'exclusion de l'application des dispositions relatives aux grands projets, aux projets générateurs de recettes et à la pérennité des opérations, aux opérations couvertes par l'article 44 (instruments relevant de l'ingénierie financière), visent à renforcer la sécurité et la clarté juridiques quant au recours à une pratique existante dans ces domaines à compter du début de la période d'éligibilité comme énoncé au règlement (CE) no 1083/2006.
The amendments relating to the forms and reuse of the repayable assistance as well as to the exclusion of the application of the provisions on major projects, revenue-generating projects and durability of operations, to operations falling under Article 44 (financial engineering instruments), aim at providing for greater legal certainty and clarity concerning the application of an existing practice in these fields with effect from the beginning of the eligibility period as set out by Regulation (EC) No 1083/2006.

2. Member States shall ensure that investment firms trading in commodity derivatives or emission allowances or derivatives thereof outside a trading venue provide the competent authority of the trading venue where the commodity derivatives or emission allowances or derivatives thereof are traded or the central competent authority where the commodity derivatives or emission allowances or derivatives thereof are traded in significant volumes on trading venues in more than one jurisdiction at least on a daily basis with a complete breakdown of their positions taken in commodity derivatives or emission allowances or derivatives thereof traded on a trading venue and economically equivalent OTC contracts, as well as of those of their clients and the clients of those clients until the end client is reached, in accordance with Article 26 of Regulation (EU) No ./2014 and, where applicable, of Article 8 of Regulation (EU) No 1227/2011.

5. Aux fins du présent article, tout instrument déposé par une organisation d’intégration économique régionale ne sera pas considéré comme venant s’ajouter aux instruments déposés par ses États membres.
5. For the purposes of this Article, an instrument deposited by a regional economic integration organisation shall not be counted as additional to those deposited by its Member States.

2. La Commission est habilitée à adopter des actes délégués conformément à l'article 18 concernant des modifications à apporter aux indicateurs mentionnés à l'article 2, paragraphe 2, et à l'annexe I, des modifications au budget des instruments financiers à l'article 4, paragraphe 1, ainsi qu'aux instruments financiers eux-mêmes aux articles 14, 14 bis et 14 ter, si l'évolution de la situation économique le requiert ou en fonction des résultats atteints par la facilité LGF (Loan Guarantee Facility) du programme cadre Compétitivité et innovation et de l'instrument RSI (Risk Sharing Instrument) du 7 programme-cadre pour la facilité de financement avec partage des risques.
2. The Commission shall be empowered to adopt delegated acts in accordance with Article 18 concerning changes to the indicators in Article 2 (2) and Annex I, changes to the budget for financial instruments in Article 4(1) and to the financial instruments themselves in Articles 14, 14a and 14b if economic market developments so require or according to the results achieved by the Competitiveness and Innovation Framework Programme Loan Guarantee Facility (LGF) and the Risk Sharing Instrument (RSI) of the 7th Framework Programme for Risk Sharing Financial Facility.

Where the composition of assets which are used as underlyings by financial derivatives in accordance with Article 19(1) of Directive 85/611/EEC does not fulfil the criteria set out in paragraph 1 of this Article, those financial derivatives shall, where they comply with the criteria set out in Article 8(1) of this Directive, be regarded as financial derivatives on a combination of the assets referred to in points (i), (ii) and (iii) of Article 8(1)(a).

1. Member States may decide not to apply Article 10(1), (2) and (3) where, upon a decision of the administrative or the management body, transferable securities as defined in Article 4(1)(18) of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments * or money-market instruments as defined in Article 4(1)(19) of that Directive are contributed as consideration other than in cash, and those securities or money-market instruments are valued at the weighted average price at which they have been traded on one or more regulated market(s) as defined in Article 4(1)(14) of that Directive during a sufficient period, to be determined by national law, preceding the effectuation of the respective consideration other than in cash .

4. Pour tout gouvernement au nom duquel un instrument de ratification, d'acceptation, d'approbation ou d'adhésion ou une notification d'application à titre provisoire est déposé après l'entrée en vigueur du présent accord conformément au paragraphe 1, au paragraphe 2 ou au paragraphe 3 du présent article, l'instrument ou la notification prend effet à la date du dépôt, et en ce qui concerne la notification d'application à titre provisoire, conformément aux dispositions du paragraphe 1 de l'article 57.
4. For a government on whose behalf an instrument of ratification, acceptance, approval or accession or a notification of provisional application is deposited after the entry into force of this Agreement in accordance with paragraph 1, paragraph 2 or paragraph 3 of this Article, the instrument or notification shall take effect on the date of such deposit and, with regard to notification of provisional application, in accordance with the provisions of paragraph 1 of Article 57.
