Par ailleurs, dans le mémoire en réponse, M. Meierhofer excipe de l’irrecevabilité du pourvoi au motif que la Commission n’aurait plus d’intérêt à agir, ladite institution ayant déjà satisfait aux obligations que l’arrêt attaqué impliquait à son égard avec la communication à M. Meierhofer des notes intermédiaires de son épreuve orale.
Moreover, in his response, Mr Maierhofer argues that the appeal is inadmissible on the ground that the Commission no longer has a legal interest in bringing the proceedings since it has already fulfilled its obligations flowing from the judgement under appeal with respect to communication to Mr Maierhofer of the intermediate marks for his oral test.
