À titre liminaire, tout en relevant que les nouvelles lignes directrices de la Commission , n’étaient pas applicables au moment de l’adoption de la décision citée, le Tribunal décide de s’y référer car elles codifient la pratique de la Commission relative à l’application des critères de l’arrêt Altmark et fournissent des indications utiles sur l’application desdits critères dans le secteur des communications électroniques à très haut débit.
First of all, while observing that the Commission’s new guidelines were not applicable at the time the decision cited was adopted, the General Court decides to refer to them because they codify the Commission’s practice concerning the application of the criteria of the Altmark judgment and provide useful guidance on the application of those criteria in the very-high-speed electronic communications sector.

In its Altmark judgment, the Court stated that public service compensation does not constitute an economic advantage in the meaning of Article 107(1) of the EC Treaty if all of the following four conditions are met: 1. the recipient undertaking must actually have a public service mandate and the tasks and related obligations must be clearly defined; 2. the parameters of the compensation must be established in advance in an objective and transparent manner; 3. the compensation must not exceed the costs incurred in discharging the public service mandate; 4. in order to ensure the least cost to the community, the company which is to discharge public service obligations is chosen either through public procurement, or the costs of providing the services of general economic interest are determined on the basis of the costs of a typical, well-run undertaking.

L’avocat général fait observer que, dans l’arrêt Altmark Trans et Regierungspräsidium Magdeburg , la Cour, notamment a cherché, en adoptant une approche prescriptive, à éliminer toute possibilité de manipulation de la part des États membres et à apporter de la transparence et de la clarté dans les activités exercées par les États membres sur le marché.
The Advocate General points out that inter alia in Altmark the Court took a prescriptive approach, seeking to eliminate any possibility of manipulation on the part of the Member States and to bring transparency and clarity into the Member States’ activities on the market.

À cet égard, les autorités danoises soulignent que, tout comme l’affaire BUPA (30), l’affaire TV2 concerne une situation qui existait déjà avant le prononcé de l’arrêt Altmark.
They recalled that, like the BUPA case (30), the TV2 case concerned circumstances already in existence prior to the date of the Altmark judgment.

2. recommande que les dispositions soient appliquées sans retard, de façon à limiter à un minimum le vide juridique entre le prononcé de l'arrêt Altmark et la date d'entrée en vigueur des dispositions proposées; estime que, dans l'attente de leur entrée en vigueur, ces dispositions doivent s'appliquer à toutes les aides d'État octroyées après l'arrêt Altmark et répondant aux conditions visées aux articles 1 et 2 de la décision; considère que les aides d'État qui ne remplissent pas ces conditions devraient être traitées conformément aux directives-cadres, lignes directrices et avis pertinents;
2. Recommends that the arrangements be put in place without delay, so as to limit to a minimum the legal gap that exists between the pronouncement of the Altmark ruling and the date on which the proposed arrangements are to enter into force; considers that, pending their entry into force, these arrangements should apply to all state aid granted after the Altmark ruling and fulfilling the conditions laid down in Articles 1 and 2 of the Decision; considers that state aid not fulfilling those conditions should be dealt with in accordance with the relevant framework directives, guidelines and opinions;

2. recommande que les dispositions soient appliquées sans retard, de façon à limiter au minimum le vide juridique qui s'installera entre le prononcé de l'arrêt Altmark et la date d'entrée en vigueur des dispositions proposées; estime que, dans l'attente de leur entrée en vigueur, ces dispositions doivent s'appliquer à toutes les aides d'État octroyée à la suite de l'arrêt Altmark et qui remplissent les conditions visées aux articles 1 et 2 de la décision; considère que les aides d'État qui ne remplissent pas ces conditions doivent être traitées conformément aux directives-cadres, lignes directrices et avis pertinents;
