4. In accordance with the Fund-specific rules, the Commission shall approve each programme no later than six months following its submission by the Member State concerned, provided that any observations made by the Commission have been adequately taken into account, but not before 1 January 2014 or before adoption by the Commission of a decision approving the Partnership Agreement.

2. Les autorités compétentes ne donnent leur approbation à l'accord d'interopérabilité que si les contreparties centrales concernées ont été agréées pour procéder à la compensation au titre de l'article 17, reconnues au titre de l'article 25, ou agréées au titre d'un régime national d'agrément préexistant pendant au moins trois ans, si les exigences prévues à l'article 52 sont remplies, si les conditions techniques régissant la compensation des transactions selon les modalités de l'accord sont conciliables avec un fonctionnement harmonieux et ordonné des marchés financiers et si l'accord ne nuit pas à l'efficacité de la surveillance.
2. The competent authorities shall grant approval of the interoperability arrangement only where the CCPs involved have been authorised to clear under Article 17 or recognised under Article 25 or authorised under a pre-existing national authorisation regime for a period of at least three years, the requirements laid down in Article 52 are met and the technical conditions for clearing transactions under the terms of the arrangement allow for a smooth and orderly functioning of financial markets and the arrangement does not undermine the effectiveness of supervision.

Le Conseil ayant adopté, le 20 juin 2011 (1), une décision concernant l’approbation de l’accord cité en objet, l’Union européenne a déposé son instrument d’approbation auprès du directeur général de la FAO le 7 juillet 2011.
