IN-CONTEXT TRANSLATIONS

Premièrement, demande d’annulation de la décision de l’AESA du 13 janvier 2012 rejetant la demande de la requérante visant à obtenir l’approbation des conditions de vol présentée pour un hélicoptère de type Robinson R66 (numéro de série 0034), deuxièmement, demande tendant à ce que soit constatée la carence de l’AESA concernant le traitement des demandes de la requérante du 11 juillet 2011 et du 10 janvier 2012 concernant ledit hélicoptère et, troisièmement, demande tendant à ce que l’AESA répare le préjudice que la requérante estime avoir subi en raison de cette décision de rejet et de cette carence alléguée.
First, application for annulment of the decision of the EASA of 13 January 2012 rejecting the applicant’s application for approval of flight conditions submitted for a Robinson R66 helicopter (serial number 0034); secondly, application for a declaration that the EASA failed to act concerning the processing of the applicant’s applications of 11 July 2011 and 10 January 2012 concerning that helicopter and, thirdly, claim that the EASA should make good the damage that the applicant considers it has suffered because of that rejection decision and that alleged failure to act.

Afin de préciser les exigences énoncées dans le présent règlement, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne les informations à inclure au minimum dans certains documents qui doivent être rendues publiques dans le cadre d’une offre publique d’acquisition par voie d’offre publique d’échange, d’une fusion ou d’une scission, l’examen, l’approbation, le dépôt et la revue du document d’enregistrement universel et de ses amendements ainsi que les conditions dans lesquelles le statut d’émetteur fréquent est perdu, la forme du prospectus, du prospectus de base et des conditions définitives, et les informations spécifiques à inclure dans un prospectus, les informations à inclure au minimum dans le document d’enregistrement universel, les informations allégées à inclure dans le prospectus simplifié en cas d’émissions secondaires et par les PME, le contenu allégé spécifique, la forme normalisée et l’ordre des parties du prospectus de croissance de l’Union et de son résumé spécifique, les critères d’évaluation et de présentation des facteurs de risque par l’émetteur, l’examen et l’approbation des prospectus et les critères d’équivalence généraux pour les prospectus établis par des émetteurs de pays tiers.
In order to specify the requirements set out in this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union (TFEU) should be delegated to the Commission in respect of the minimum information content of certain documents to be made available to the public in connection with a takeover by means of an exchange offer, a merger or a division, the scrutiny, approval, filing and review of the universal registration document and any amendments thereto as well as the conditions under which the status of frequent issuer is lost, the format of the prospectus, the base prospectus and the final terms, and the specific information which must be included in a prospectus, the minimum information to be included in the universal registration document, the reduced information to be included in the simplified prospectus in cases of secondary issuances and by SMEs, the specific reduced content and standardised format and sequence of the EU Growth prospectus and its specific summary, the criteria for assessment and presentation of risk factors by the issuer, the scrutiny and approval of prospectuses and the general equivalence criteria for prospectuses drawn up by third country issuers.

Afin d'assurer des conditions uniformes d'exécution du présent règlement, il convient de conférer des compétences d'exécution à la Commission en ce qui concerne le contenu des programmes de développement rural et des cadres nationaux, l'approbation des programmes et leur modification, les procédures et calendriers pour l'approbation des programmes, les procédures et les calendriers pour l'approbation des modifications à apporter aux programmes et aux cadres nationaux, y compris la date de leur entrée en vigueur et la fréquence de présentation, les règles relatives aux méthodes de paiement des coûts supportés par les participants pour le transfert de connaissances et les actions d'information, les conditions spécifiques pour la mise en œuvre des mesures de développement rural, la structure et le fonctionnement des réseaux mis en place par le présent règlement, les exigences en matière d'information et de publicité, l'adoption du système de suivi et d'évaluation et les règles de fonctionnement du système d'information et les règles applicables à la présentation des rapports annuels sur la mise en œuvre.
In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission, in relation to the content of rural development programmes and national frameworks, the approval of programmes and of modifications thereto, the procedures and timetables for approval of programmes, the procedures and timetables for the approval of modifications to programmes and to national frameworks, including their entry in to force and frequency of submission, the rules on payment methods for participants' costs for knowledge transfer and information actions, specific conditions for the implementation of rural development measures, the structure and operation of networks set up by this Regulation, the information and publicity requirements, the adoption of the monitoring and evaluation system and the rules for the operation of the information system, and the rules concerning the presentation of the annual implementation reports.

Cet État membre informe les autres États membres et la Commission lorsqu’il estime que les conditions de l’approbation de la substance active, du phytoprotecteur ou du synergiste contenu dans le produit phytopharmaceutique ne sont plus remplies ou, dans le cas d’un coformulant, si celui-ci a été jugé inacceptable, et propose de retirer l’approbation ou d’en modifier les conditions.
That Member State shall inform the other Member States and the Commission where it considers that the conditions of the approval of the active substance, safener or synergist contained in the plant protection product are no longer fulfilled or whether in the case of a co-formulant it has been considered unacceptable and propose that the approval be withdrawn or the conditions amended.

La demande d’approbation ou de modification des conditions d’approbation d’une substance active est introduite par le producteur de la substance active auprès d’un État membre, dénommé «l’État membre rapporteur», et est accompagnée d’un dossier récapitulatif et d’un dossier complet, établis conformément à l’article 8, paragraphes 1 et 2, ou d’une justification scientifique de la non-communication de certaines parties de ces dossiers; il doit être démontré que la substance active satisfait aux critères d’approbation établis à l’article 4.

An application for the approval of an active substance or for an amendment to the conditions of an approval shall be submitted by the producer of the active substance to a Member State, (the rapporteur Member State), together with a summary and a complete dossier as provided for in Article 8(1) and (2) or a scientifically reasoned justification for not providing certain parts of those dossiers, demonstrating that the active substance fulfils the approval criteria provided for in Article 4.

(b) decisions taken or contracts made by the management body of an issuer which need the approval of another body of the issuer in order to become effective, where the organisation of such an issuer requires the separation between these bodies, provided that a public disclosure of the information before such approval together with the simultaneous announcement that this approval is still pending would jeopardise the correct assessment of the information by the public.

L'actuelle coordination ne fait pas obstacle à ce que les États membres maintiennent ou introduisent des dispositions législatives, réglementaires ou administratives, notamment en ce qui concerne l'approbation des conditions générales et spéciales des polices d'assurance, des formulaires et autres imprimés destinés à être utilisés dans les relations avec les preneurs, des tarifs et de tout autre document nécessaire à l'exercice normal du contrôle, à condition toutefois que les règles de l'État membre de l'établissement ne suffisent pas pour atteindre le niveau de protection nécessaire et que les exigences de l'État membre de prestation de services n'aillent pas au-delà de ce qui est nécessaire à cet égard .
This coordination shall not prevent the Member States from maintaining or introducing laws, regulations or administrative provisions concerning, in particular, approval of general and special policy conditions, of forms and other printed documents for use in dealing with policy-holders, of scales of premiums and of any other document necessary for the normal exercise of supervision provided that the rules of the Member State of establishment are not sufficient to achieve the necessary level of protection and the requirements of the Member State of provision of services do not go beyond what is necessary in that respect.

3. These coordinating measures do not prevent Member States from enforcing provisions requiring, for all insurance undertakings, approval of the general and special policy conditions, tariffs and any other document necessary for the normal exercise of supervision.
