As regards Iceland and Norway, this [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application and development of the Schengen acquis* which fall within the area referred to in Article 1, point [...], of Council Decision 1999/437/EC of 17 May 1999 on certain arrangements for the application of that Agreement**.

Points out that 2011 was the second full year in which the new Statute for Members and the Statute for Assistants has been in force (both effective as of 14 July 2009); notes that the Implementing Measures for the Statute for Assistants have been amended four times in those two years for the application of Title VII of the Conditions of Employment of Other Servants of the European Union (CEOS) and the Implementing Measures on the basis of proposals from the Temporary Evaluation Group and the Secretary-General; recalls that the implementation of Title VII of the CEOS created a single scheme governing the status of accredited parliamentary assistants (APAs) working in Parliament's three working places, which replaced twenty-seven different national systems of contractual relationships, taxation and social security and that currently there is no evidence that would suggest a need to adapt the rules applying to parliamentary assistants contained in Title VII of the CEOS; suggests a full evaluation of the Statute of Assistants including possible adaptations of the rules before the next European elections;

9. souligne l'urgente nécessité d'introduire des règles administratives plus étendues pour la procédure applicable au titre de l'actuel règlement (CE) n° 1049/2001 du Parlement européen et du Conseil du 30 mai 2001 relatif à l'accès du public aux documents du Parlement européen, du Conseil et de la Commission adopté sur la base de l'article 15 du traité FUE, en particulier dans la perspective d'une codification de la jurisprudence pertinente de la Cour de justice de l'Union européenne et de l'élargissement du champ d'application de ce règlement à l'ensemble de l'administration de l'Union; il conviendrait également de mettre en place des dispositions plus efficaces en ce qui concerne la procédure applicable au traitement des données à caractère personnel – en particulier pour l'application concrète des droits que cette procédure garantit aux citoyens – au titre de l'actuel règlement (CE) n° 45/2001 du Parlement européen et du Conseil du 18 décembre 2000 relatif à la protection des personnes physiques à l'égard du traitement des données à caractère personnel par les institutions et organes communautaires et à la libre circulation de ces données, adopté sur la base de l'article 16 du traité FUE; admet cependant que grâce aux deux règlements en question, une codification de deux domaines du droit administratif commun de l'Union a eu lieu, que cette codification a déjà permis l'introduction de procédures administratives relativement claires, et que tout développement de ces procédures devrait se fonder sur ce qui a déjà été atteint jusqu'ici;
9. Stresses the urgent need to introduce more extensive administrative rules for the procedure applicable under the current Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 on public access to European Parliament, Council and Commission documents, to be adopted on the basis of Article 15 TFEU, with particular regard to codifying the relevant case-law of the Court of Justice and extending the scope of the Regulation to the whole of the EU’s administration; similarly, more effective provisions ought to exist concerning the procedure applicable to the processing of personal data – particularly regarding implementation of the citizens’ rights guaranteed therein – under the current Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data, to be adopted on the basis of Article 16 TFEU; acknowledges, however, that the regulations mentioned have led to the codification of two areas of general Union administrative law, which has already enabled relatively clear administrative procedures to be introduced, and that the further development of these should build on what has been achieved to date;

Enfin, en termes d’efficacité, il ne me semble pas pertinent de prévoir deux mécanismes distincts pour chacune des deux phases d’évaluation que sont le contrôle préalable à l’application de l’acquis et son application par les États Schengen.
Lastly, in terms of effectiveness, it does not seem appropriate to me to provide for two separate mechanisms for the two evaluation stages, which are the check prior to the application of the acquis and the application of the acquis by the Schengen States.

3. La détermination provisoire de la législation applicable visée au paragraphe 2 devient définitive dans les deux mois suivant sa notification à l’institution désignée par les autorités compétentes des États membres concernés, conformément au paragraphe 2, sauf si la législation a déjà fait l’objet d’une détermination définitive en application du paragraphe 4, ou si au moins une des institutions concernées informe l’institution désignée par l’autorité compétente de l’État membre de résidence, à l’expiration de cette période de deux mois, qu’elle ne peut encore accepter la détermination ou qu’elle a un avis différent à cet égard.
3. The provisional determination of the applicable legislation, as provided for in paragraph 2, shall become definitive within two months of the institutions designated by the competent authorities of the Member States concerned being informed of it, in accordance with paragraph 2, unless the legislation has already been definitively determined on the basis of paragraph 4, or at least one of the institutions concerned informs the institution designated by the competent authority of the Member State of residence by the end of this two-month period that it cannot yet accept the determination or that it takes a different view on this.

Les seuils fixés au paragraphe 3 sont applicables à l'intensité d'aide calculée soit en pourcentage des coûts admissibles des investissements en immobilisations corporelles et incorporelles, soit en pourcentage des coûts salariaux estimés correspondant à la personne embauchée, calculés sur une période de deux ans, pour les emplois directement créés par le projet d'investissement, ou encore en combinant les deux méthodes de calcul, à condition que l'aide ne dépasse pas le montant le plus favorable résultant de l'application de l'une ou de l'autre de ces méthodes.
5. The thresholds fixed in paragraph 3 shall apply to the intensity of the aid calculated either as a percentage of the investment’s eligible tangible and intangible costs or as a percentage of the estimated wage costs of the person hired, calculated over a period of two years, for employment directly created by the investment project or a combination thereof, provided that the aid does not exceed the most favourable amount resulting from the application of either calculation.
