6 (1) La personne responsable d’un groupe existant qui cesse de produire de l’électricité après le 30 juin 2015 — ci-après « groupe mis en arrêt » — peut, sur présentation d’une demande au ministre, être autorisée à se prévaloir d’une application différée du paragraphe 3(1) à l’égard d’un ou de plusieurs groupes — ci-après « groupes bénéficiaires » — pour le nombre d’années civiles comprises dans la période qui commence le 1 janvier de l’année civile suivant celle au cours de laquelle le groupe existant cesse de produire de l’électricité et se termine le 31 décembre de l’année civile au cours de laquelle ce groupe atteint la fin de sa vie utile.
6 (1) A responsible person for an existing unit that ceases to produce electricity after June 30, 2015 (referred to in this section as the “shut-down unit”) may apply to the Minister to have the application of subsection 3(1) deferred in respect of another unit or units (referred to in this section as the “deferred units”) for the number of years in the period that begins on January 1 of the calendar year that follows that cessation and that ends on December 31 of the calendar year in which the useful life of the shut-down unit ends.

By way of derogation from the second subparagraph of Article 59(2) and the second subparagraph of Article 59(4) of Regulation (EC) No 796/2004, the amount resulting from the exclusion shall be off-set against aid payments under any of the support measures under Regulation (EC) No 1698/2005 to which the beneficiary concerned is entitled in the context of applications he lodges in the course of the three calendar years following the calendar year of the finding.
