L’Allemagne est d’avis que l’annexe II, partie III, point 8, de la directive ne concerne que les jouets pour les enfants de moins de trois ans et d’autres jouets destinés à être mis en bouche.
Point 8 of Annex II, Part III, to the Directive addresses, in Germany’s opinion, only toys for children under 3 and other toys intended to be placed in the mouth.

Bien qu’il s’agisse ici de [.] pouvant s’élever à [.] euros, l’Allemagne est d’avis que le risque de [.] est très limité puisque, un mois avant la crise financière, IKB occupait, grâce à ses très bons résultats, la deuxième place dans la notation des banques allemandes et que, selon l’évaluation de [.] sur la base des informations disponibles, la banque ne s’est pas écartée de sa pratique commerciale courante.
Although this concerns [.] which could reach EUR [.] billion, Germany argued that the risk [.] is very small given that one month before the crisis IKB was the second best-rated bank in Germany with very good results, and the assessment of the [.] did not, according to the information available, deviate from the usual business practice.

Germany was of the opinion that the measure constituted ‘implementation of the authorisation granted to Member States (.) [by the above-mentioned Directives] (.)’.

Regrets, particularly in the light of the above-mentioned shortcomings observed by the Court of Auditors with regard to Germany, that Germany did not comply with the Court of Auditors' audit request; supports the Court of Auditors' view that Germany's refusal constitutes a breach of its obligations under the EC Treaty; notes that the Commission has started infringement proceedings before the Court of Justice against Germany; invites the Court of Auditors to carry out the planned audit in Germany in the case of a finding of infringement by the Court of Justice;

Dans son avis du 17 février 2005 relatif à la mise à jour de décembre 2004 du programme de stabilité, qui couvrait la période 2004-2008, le Conseil avait invité l'Allemagne à faire le nécessaire afin de garantir la correction du déficit excessif en 2005, à procéder à des ajustements budgétaires au cours des années qui suivent et à consentir l'effort requis en termes structurels pour parvenir à une position budgétaire proche de l'équilibre d'ici la fin de la période couverte par le programme, ainsi qu'à poursuivre les réformes structurelles afin d'améliorer encore la viabilité à long terme des finances publiques, notamment en ce qui concerne le système des soins de santé.
In its opinion of 17 February 2005 on the December 2004 update of the stability programme, covering the period 2004-2008, the Council invited Germany: to do the necessary to ensure the correction of the excessive deficit in 2005; to implement budgetary adjustments in the years beyond 2005 and make the necessary effort in structural terms to achieve a budgetary position of close to balance by the end of the period covered by the programme; and to continue with structural reforms in order to further improve the long-term sustainability of public finances in particular as regards the health care system.
