La directive de l'UE concernant les marchés d'instruments financiers (MiFID 1) impose aux entreprises d'investissement de communiquer aux clients des informations sur les instruments financiers, notamment des orientations et des mises en garde appropriées contre les risques, de manière à leur permettre de comprendre la nature du service d'investissement et du type spécifique d'instrument financier et les risques qu'ils présentent.
The EU Markets in Financial Instruments Directive (MiFID 1) requires investment firms to provide clients with information about financial instruments including appropriate guidance on and warnings of the risks so that they are able to understand the nature and risks of the investment service and of the specific type of financial instrument.

The notified competent authorities of the other Member States shall require that regulated markets, other MTFs, other OTFs and systematic internalisers, which fall under their jurisdiction and trade the same financial instrument or derivatives referred to in points (4) to (10) of Section C of Annex I to this Directive that relate or are referenced to that financial instrument, also suspend or remove that financial instrument or derivatives from trading, where the suspension or removal is due to suspected market abuse, a take-over bid or the non-disclosure of inside information about the issuer or financial instrument infringing Articles 7 and 17 of Regulation (EU) No 596/2014 except where such suspension or removal could cause significant damage to the investors’ interests or the orderly functioning of the market.

In order to ensure that the obligation to suspend or remove from trading such derivatives is applied proportionately, ESMA shall develop draft regulatory technical standards to further specify the cases in which the connection between a derivative as referred to in points (4) to (10) of Section C of Annex I relating or referenced to a financial instrument suspended or removed from trading and the original financial instrument implies that the derivative is also to be suspended or removed from trading, in order to achieve the objective of the suspension or removal of the underlying financial instrument.

‘Inside information’ is defined as information which (i) is of a precise nature, (ii) has not been made public, (iii) relates, directly or indirectly, to one or more financial instruments or their issuers and (iv) if it were made public, would be likely to have a significant effect on the prices of those financial instruments or on the price of related derivative financial instruments.

Most delegations agreed with the proposal to simplify the structure given to Heading 4 ("the EU as a global partner") of the EU budget, which provides for six financial instruments for external relations; Delegations in general agreed with the proposed scope of the three geographic financing instruments for external relations, although many did not agree with the proposed inclusion of the European Development Fund in the EU budget; Many delegations considered that the proposed new financing instruments for external relations would allow the Council adequate political control, although a number highlighted conditions to be respected and emphasised the role to be played by the Member States; Many delegations were favourable to the proposed scope of the "instrument for stability", whilst emphasising the need to clarify the delimitation of competences of the Commission and the Council.

Des recommandations sont formulées sous trois rubriques: (i) mesures pour recentrer les instruments financiers disponibles sur les priorités politiques identifiées lors du Conseil européen de Lisbonne (ii) mesures pour améliorer la cohérence et la coordination entre les différents instruments financiers de la Communauté et (iii) mesures pour accroître la visibilité et l'accessibilité des actions communautaires.
Recommendations are made under three headings: (i) measures to refocus the available financial instruments on the political priorities identified at the Lisbon European Council (ii) measures to improve the coherence and co-ordination between the various Community financial instruments and (iii) measures to enhance the visibility and accessibility of Community actions.
