119. se félicite des engagements accrus de la part de l'Union et de la Tunisie, qui ressortent du plan d'action, et appelle les deux parties à l'adopter; prie instamment l'Assemblée nationale constituante de finaliser une constitution démocratique qui respecte les accords internationaux sur les droits de l'homme; demande l'organisation d'élections libres et régulières et regrette l'extension de l'état d'urgence; est d'avis que l'adoption d'une constitution résolument fondée sur les valeurs démocratiques et le respect des droits de l'homme, conformément aux souhaits des Tunisiens, un système judiciaire et des médias fonctionnels et indépendants, ainsi que la tenue de nouvelles élections, sont des éléments essentiels à la poursuite de la transition démocratique en Tunisie; est préoccupé par le nombre croissant de procès à l'encontre de journalistes en Tunisie; salue l'intégration dans le projet de constitution d'un article spécifique sur les droits de l'enfant conforme à la convention des Nations unies sur les droits de l'enfant, et recommande l'instauration d'un mécanisme indépendant afin de contrôler sa mise en œuvre;

Welcomes the strengthened commitments on the part of the Union and Tunisia as illustrated in the action plan, and calls on both parts to adopt that plan; urges the National Constituent Assembly to finalise a democratic constitution that respects international human rights agreements; calls for the organisation of free and fair elections, and regrets the extension of the state of emergency; takes the view that the adoption of a constitution firmly grounded in democratic values and respect for human rights, corresponding to the wishes of the Tunisian people, a functional and independent judiciary and media, and the holding of new elections are key elements for pursuing Tunisia’s political transition; is concerned about the increasing numbers of trials of journalists in Tunisia; welcomes the inclusion in the draft constitution of a specific article on children’s rights in line with the UN Convention on the Rights of the Child, and recommends the establishment of an independent mechanism to monitor its implementation;

E. considérant que le référendum qui a eu lieu en décembre 2012, avec une participation électorale de 32,9 %, a adopté une nouvelle constitution pour l'Égypte; considérant que l'absence d'ouverture à tous et de transparence du processus constitutionnel et l'adoption anticipée de la nouvelle constitution ont encore approfondi les divisions internes au sein de la société égyptienne; considérant qu'il y a de grandes inquiétudes, tant en Égypte qu'au-delà, quant à divers articles de la nouvelle constitution qui vont à l'encontre des engagements internationaux de l'Égypte en matière de droits de l'homme - notamment ce qui concerne la liberté de religion, la liberté de réunion, la liberté d'expression, les droits des femmes, la séparation des pouvoirs, l'indépendance du système judiciaire - tout en préservant le rôle des tribunaux militaires;
E. whereas the referendum held in December 2012 , with a voter turnout of 32,9 %, adopted a new constitution for Egypt; whereas the lack of inclusiveness and transparency of the constitutional process, and the anticipated adoption of the new constitution, further deepened internal divisions within Egyptian society; whereas there has been widespread concern, both in Egypt and beyond, about various articles of the new constitution that run counter to Egypt’s international human rights commitment – notably with regards to freedom of religion, freedom of assembly, freedom of expression, women’s rights, the separation of powers, the independence of the judiciary – while preserving the role of military courts;

B. considérant que l'élaboration et l'adoption d'une nouvelle constitution après l'adhésion à l'Union européenne est un phénomène inhabituel et que, bien que les États membres disposent du droit exclusif d'élaborer et d'adopter de nouvelles constitutions, une attention particulière devrait être accordée, au niveau de l'Union, à la forme des documents concernés et aux processus qu'ils impliquent, afin de garantir que la lettre et l'esprit des constitutions adoptées n'aillent pas à l'encontre de ceux de l'acquis communautaire,
B. whereas the drafting and the adoption of a new constitution after EU accession is an unusual phenomenon, and whereas, although Member States have the exclusive right to draft and adopt new constitutions, particular attention should be paid at EU level to the form of the documents concerned and to the processes involved, so as to ensure that the letter and spirit of the adopted constitutions do not contradict the letter and spirit of the acquis communautaire,

7. regrette, à cet égard, l'attitude de certains États membres qui, en dépit de l'adoption de la Constitution par le Conseil européen, ont utilisé, pour des raisons intérieures, le droit de veto sur d'importantes questions relevant des affaires étrangères; fait observer que la PESC ne saurait être considérée comme un simple appendice des politiques étrangères des États membres et demande par conséquent à tous les États membres d'adopter une attitude constructive conforme à l'esprit de la Constitution, afin de permettre à l'Union européenne de jouer un rôle efficace sur la scène mondiale;
7. Regrets, in this respect, the attitude of certain Member States which, in spite of the adoption of the Constitution by the European Council, have for domestic reasons used the right of veto in important foreign affairs matters; points out that the CFSP cannot be reduced to a mere adjunct to the foreign policies of individual Member States and calls, therefore, on all Member States to act in a constructive manner in line with the spirit of the Constitution so as to enable the EU to play an effective role on the world stage;

8. se félicite de l'adoption d'une constitution par la Loya Jirga, étape importante vers le renforcement d'un gouvernement transitoire du pays sous l'autorité du président Karzai et condition fondamentale pour des élections démocratiques en juin de cette année; reconnaît que cette constitution tient compte de tous les groupes ethniques du pays et contribuera donc à une stabilisation des structures de l'État, pour autant qu'elle soit transposée dans la réalité politique; est conscient de la nécessité d'une autorité centrale efficace; se félicite de la référence expresse à l'égalité de traitement des hommes et des femmes; demeure cependant préoccupé par les points suivants: limitation du droit à la liberté d'expression et de religion et le fait que la commission indépendante afghane des droits de l'homme (AIHCR) n'ait pas la capacité d'ester en justice et le droit de saisir les tribunaux pour des violations des droits de l'homme; considère que la neutralité politique des forces armées, de la police et des services de renseignement et leur subordination au contrôle civil doivent être garanties, de même que l'indépendance du système judiciaire et de la fonction publique; espère que ces entraves pourront être levées au moment de l'application future de la Constitution;
8. Welcomes the adoption of a constitution by the Loya Jirga as an important step towards strengthening a transitional government for Afghanistan under President Karzai, and as a fundamental precondition for democratic elections in June 2004; recognises that this constitution takes account of all ethnic groups in the country and will thus contribute to the stabilisation of state structures, provided that it is translated into political reality; realises the need for an effective central authority; is pleased to note the specific reference to the equal treatment of men and women; remains concerned, however, about the following points: restrictions on the rights of freedom of speech and freedom of religion and the fact that the Afghan Independent Human Rights Commission (AIHCR) does not have locus standi in the courts or the right to bring human rights violations to court; considers that the political neutrality of the armed forces, the police and the intelligence services and their subordination to civilian control should be guaranteed, as should the independence of the judiciary and the civil service; hopes these obstacles can be removed at the time of the future application of the Constitution;

1. Lorsque les organes de direction ou d'administration des sociétés participantes établissent le projet de constitution d'une SE, ils prennent, dès que possible après la publication du projet de fusion ou de constitution d'une société holding ou après l'adoption d'un projet de constitution d'une filiale ou de transformation en une SE, les mesures nécessaires, y compris la communication d'informations concernant l'identité des sociétés participantes, des filiales ou des établissements, ainsi que le nombre de leurs travailleurs, pour engager des négociations avec les représentants des travailleurs des sociétés sur les modalités relatives à l'implication des travailleurs dans la SE.
1. Where the management or administrative organs of the participating companies draw up a plan for the establishment of an SE, they shall as soon as possible after publishing the draft terms of merger or creating a holding company or after agreeing a plan to form a subsidiary or to transform into an SE, take the necessary steps, including providing information about the identity of the participating companies, concerned subsidiaries or establishments, and the number of their employees, to start negotiations with the representatives of the companies' employees on arrangements for the involvement of employees in the SE.
