35. se félicite du processus de réforme constitutionnelle en cours dans les domaines de la décentralisation et de la justice; rappelle que la commission de Venise du Conseil de l'Europe a publié des recommandations positives concernant les deux séries d'amendements constitutionnels; souligne que l’adoption des amendements relatifs au pouvoir judiciaire ouvrira la voie à une réforme globale du système judiciaire et, par conséquent, se félicite de la décision prise récemment par le Parlement ukrainien d’envoyer ces amendements à la Cour constitutionnelle; souligne qu'outre le fait de tenir compte des exigences établies par les accords de Minsk, les amendements portant sur la décentralisation contribueront de manière décisive à moderniser le pays; invite dès lors le Parlement ukrainien à procéder rapidement à l’adoption de ces amendements en deuxième lecture;
35. Welcomes the ongoing constitutional reform process in the areas of decentralisation and judiciary; recalls that the Venice Commission of the Council of Europe has issued positive recommendations on both sets of constitutional amendments; stresses that the adoption of the amendments on the judiciary will pave the way for a comprehensive reform of the judicial system, and therefore welcomes the step recently taken by the Ukrainian parliament to send these amendments to the Constitutional Court; underlines the fact that the amendments on decentralisation, besides reflecting a requirement of the Minsk Agreements, will decisively contribute to the modernisation of the country; calls therefore on the Ukrainian parliament to swiftly proceed with the adoption of these amendments in second reading;

Je me demande si le gouvernement a déterminé comment il facilitera l'apport d'un tel amendement au projet de loi et s'il a envisagé de proposer une motion d'instruction au comité après l'adoption du projet de loi à l'étape de la deuxième lecture juste pour s'assurer que ces amendements peuvent être adoptés.
I am wondering if the government has actually scoped out how it intends to facilitate the amendment of this nature to the bill and whether it has considered a possible motion of instruction to the committee that would follow adoption of the bill at second reading, just to ensure that those amendments can happen.

Le présent amendement de compromis tend à préciser que toute future modification concernant les mesures d'exécution, que ce soit par le biais de l'adoption d'une nouvelle "Constitution pour l'Europe" ou au travers de l'adoption d'un amendement à la décision relative à la comitologie, implique que la Commission procède à un réexamen de la directive et propose toute modification appropriée. Ce réexamen doit être effectué avant le 31 décembre 2007.
The proposed compromise amendment clarifies that any future amendment regarding implementing measaures, whether that via the adoption of a new "Constituion for Europe" or the adoption of an amendment of the Comitology decision, should mean that the Commission must make a review and propose any commensurate changes regarding the directive and that this review must by carried out at the latest by 31 December 2007.
