An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.

As regards Liechtenstein, this Regulation constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis which fall within the area referred to in Article 1, point G of Council Decision 1999/437/EC of 17 May 1999 read in conjunction with Article 3 of Council Decision 2008/261/EC of 28 February 2008 on the signature, on behalf of the European Community, and on the provisional application of certain provisions of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (18),

Conformément à l'article 3, paragraphe 2, deuxième alinéa, de l'acte d'adhésion de 2003 et du fait de l'application partielle de l'acquis de Schengen par le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord prévue dans la décision 2004/926/CE du Conseil du 22 décembre 2004 relative à la mise en œuvre de certaines parties de l'acquis de Schengen par le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord (5), et en particulier son article 1er, premier alinéa, une partie seulement des dispositions de l'acquis de Schengen applicables aux États membres concernés dans leurs relations avec les États membres qui appliquent la totalité de l'acquis de Schengen devrait s'appliquer dans les relations des États membres concernés avec le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord.
In accordance with the second subparagraph of Article 3(2) of the 2003 Act of Accession and as a result of the partial application of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland provided for in Council Decision 2004/926/EC of 22 December 2004 on the putting into effect of parts of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland (5), and in particular the first subparagraph of Article 1 thereof, only part of the provisions of the Schengen acquis applicable to the Member States concerned in their relations with Member States applying the Schengen acquis in full should apply in the relations of the Member States concerned with the United Kingdom of Great Britain and Northern Ireland.

E. whereas it is necessary to conduct a verification through evaluation procedures in order to check whether the necessary conditions for the application of all parts of the acquis concerned (data protection, air borders, land borders, police cooperation, the SIS, sea borders and visas) have been met by the new Member States; whereas this is a precondition for the Council to take decisions on the full application of the Schengen acquis, including the abolition of checks at internal borders with and between those Member States,

C. considérant que, conformément à l'article 3, paragraphe 2, de l'acte d'adhésion de 2003 , les dispositions de l'acquis de Schengen autres que celles qui sont mentionnées à l'annexe I dudit acte ne s'appliquent dans un nouvel État membre, au sens dudit instrument, qu'à la suite d'une décision du Conseil à cet effet, après qu'il a été vérifié que les conditions nécessaires à l'application de cet acquis sont remplies,

Ireland is taking part in this Regulation, in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the TEU and to the TFEU, and Article 6(2) of Council Decision 2002/192/EC of 28 February 2002 concerning Ireland’s request to take part in some of the provisions of the Schengen acquis (10).

The United Kingdom is taking part in this Regulation, in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the Union, annexed to the TEU and to the TFEU, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis (9).
