(14) Third-country nationals who are in possession of a valid travel document and a single permit issued by a Member State applying the Schengen acquis in full, should be allowed to enter into and move freely within the territory of the Member States applying the Schengen acquis in full, for a period up to three months in accordance with Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code) and Article 21 of the The Schengen acquis - Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders (Schengen Implementing Convention) .

Conformément au protocole intégrant l’acquis de Schengen dans le cadre de l’Union européenne, le présent règlement constitue un développement de l’acquis de Schengen, tel que défini par l’annexe A de la décision 1999/435/CE[13] du Conseil du 20 mai 1999 relative à la définition de l’acquis de Schengen en vue de déterminer, conformément aux dispositions pertinentes du traité instituant la Communauté européenne et du traité sur l’Union européenne, la base juridique de chacune des dispositions ou décisions qui constituent l’acquis.
9. This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC[13] of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

(12) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.

Conformément à l'article 3, paragraphe 2, deuxième alinéa, de l'acte d'adhésion de 2003 et du fait de l'application partielle de l'acquis de Schengen par le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord prévue dans la décision 2004/926/CE du Conseil du 22 décembre 2004 relative à la mise en œuvre de certaines parties de l'acquis de Schengen par le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord (5), et en particulier son article 1er, premier alinéa, une partie seulement des dispositions de l'acquis de Schengen applicables aux États membres concernés dans leurs relations avec les États membres qui appliquent la totalité de l'acquis de Schengen devrait s'appliquer dans les relations des États membres concernés avec le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord.
In accordance with the second subparagraph of Article 3(2) of the 2003 Act of Accession and as a result of the partial application of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland provided for in Council Decision 2004/926/EC of 22 December 2004 on the putting into effect of parts of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland (5), and in particular the first subparagraph of Article 1 thereof, only part of the provisions of the Schengen acquis applicable to the Member States concerned in their relations with Member States applying the Schengen acquis in full should apply in the relations of the Member States concerned with the United Kingdom of Great Britain and Northern Ireland.

Le Conseil a maintenant vérifié, conformément aux procédures d'évaluation Schengen applicables énoncées dans la décision du comité exécutif du 16 septembre 1998 concernant la création d'une commission permanente d'évaluation et d'application de Schengen [SCH/Com-ex (98) 26 def] (2), que les conditions nécessaires à l'application de l'acquis de Schengen étaient remplies dans les États membres concernés pour tous les autres domaines de l'acquis (frontières aériennes, frontières terrestres, coopération policière, système d'information Schengen, frontières maritimes et visas).
The Council has now verified, in accordance with the applicable Schengen evaluation procedures as set out in the Decision of the Executive Committee of 16 September 1998 setting up a Standing Committee on the evaluation and implementation of Schengen (SCH/Com-ex (98) 26 def.) (2), that the necessary conditions for the application of the Schengen acquis have been met in all other areas of the Schengen acquis — Air Borders, Land Borders, Police Cooperation, the Schengen Information System, Sea Borders and Visas — in the Member States concerned.

G. whereas the evaluations for these new Member States started, following a request (in 2006) from each Member State (declaration of readiness); whereas they were conducted, new Member State by new Member State, under the responsibility of the Schengen Evaluation Working Party; whereas they started with a questionnaire to the Member State concerning all parts of the Schengen acquis and were followed by evaluation visits; whereas teams of experts were sent to the borders, consulates, SIS, etc. and prepared exhaustive reports containing factual descriptions, assessments, and recommendations which can require additional measures and follow-up visits; whereas the final report should establish whether the new Member State concerned, after being subject to a full evaluation procedure, fulfils all the preconditions for the practical application,
