An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.

Objet et champ d'application: Comme dans le système actuel, les règles s'appliquent non seulement pour contrôler l'application correcte de l'acquis de Schengen par les pays qui sont déjà membres de l'espace Schengen, mais aussi pour contrôler que les pays souhaitant adhérer à l'espace Schengen remplissent toutes les conditions nécessaires pour commencer à appliquer l'acquis de Schengen.
Purpose and scope: As under the current system, the rules do not only apply to verifying the correct application of the Schengen acquis by those countries which are already part of the Schengen area, but also to verifying that countries wishing to join the Schengen area meet all the conditions to start applying the Schengen acquis.

Compte tenu du fait que les nouveaux États membres n'appliquent pas encore toutes les dispositions de l'acquis de Schengen et que, de ce fait, les contrôles aux frontières avec les États Schengen actuels, ainsi qu'entre les nouveaux États membres eux-mêmes, demeureront en place pendant un certain temps, ce nouveau règlement s'étend aussi à ces frontières «temporaires».
Since the new Member States do not apply yet all the provisions of the Schengen rules and that, consequently, checks at the borders with current Schengen States and between the new Member States themselves will remain in place for a certain period, this Regulation also covers these “temporary” borders.

In order to achieve an application and interpretation as uniform as possible of the Schengen acquis provisions, the Agreement establishes in particular that the Mixed Committee will keep under constant review the development of the case law of the Court of Justice of the European Communities as well as of the case law of the competent courts of Iceland and Norway relating to such provisions.

5.2. S'agissant de l'élaboration des mesures d'accompagnement à la suppression des contrôles des personnes au niveau de la Communauté, il convient de constater qu'en général, dans les enceintes intergouvernementales des Douze, le groupe de Schengen n'a pas formé un Cartel imposant aux autres Etats membres d'avaler sans dérogation possible l'acquis de Schengen.
5.2 With regard to the preparation of the measures accompanying the abolition of checks on individuals at Community level, it should be noted that, generally speaking, in the intergovernmental bodies of the Twelve the Schengen Member States have not formed an alliance seeking to impose the Schengen rules on the other Member States without any possibility of derogation.
