reconnaître que la protection des données et le droit à la vie privée ne sont pas des obstacles aux échanges, mais des droits fondamentaux, consacrés à l'article 39 du traité UE, aux articles 7 et 8 de la charte des droits fondamentaux de l'Union européenne, ainsi qu'à l'article 12 de la déclaration universelle des droits de l'homme; reconnaître qu'un niveau élevé de confiance est essentiel en vue de développer une économie axée sur les données; garantir le plein respect de ce droit fondamental, en tenant dûment compte de l'évolution récente de l'économie numérique, et en pleine conformité avec la décision de la Cour de justice de l'Union européenne sur l'accord relatif à la sphère de sécurité; incorporer une disposition de portée générale, dépourvue d'ambiguïté, transversale, autonome et juridiquement contraignante, fondée sur l'article XIV de l'AGCS, qui exclue totalement du champ d'application de cet accord le cadre juridique actuel et futur de l'Union sur la protection des données à caractère personnel, sans qu'aucune condition n'exige que celui-ci soit en cohérence avec d'autres éléments de l'ACS; appliquer ces dispositions à toutes les autres annexes de l'ACS; soutenir sans délai et formellement ce type de propositions dans le cadre de l'annexe de l'ACS relative au commerce en ligne; appuyer les propositions visant à garantir l'application non discriminatoire des cadres juridiques nationaux de protection des données à caractère personnel des utilisateurs; appliquer les dispositions concernant la protection des données contenues dans l'annexe relative au commerce en ligne à toutes les autres annexes à l'ACS, y compris en ce qui concerne les services financiers;
to acknowledge that data protection and the right to privacy are not a trade barrier, but fundamental rights, which are enshrined in Article 39 TEU and Articles 7 and 8 of the Charter of Fundamental Rights of the European Union, as well as in Article 12 of the Universal Declaration of Human Rights; to acknowledge that a high level of trust is essential to develop a data-driven economy; to guarantee full respect of this fundamental right, taking due account of recent developments in the digital economy and in full compliance with the European Court of Justice's ruling with respect to Safe Harbour; to incorporate a comprehensive, unambiguous, horizontal, self-standing and legally binding provision based on GATS Article XIV which fully exempts the existing and future EU legal framework for the protection of personal data from the scope of this agreement, without any conditions that it must be consistent with other parts of the TiSA; to apply such provisions to all other TiSA annexes; to immediately and formally support such proposals in the TiSA e-commerce annex; to support proposals aimed at ensuring that domestic legal frameworks for the protection of personal information of users are applied on a non-discriminatory basis; to apply the data protection provisions enshrined in the annex on e-commerce to all other TiSA annexes, including on financial services;

B. whereas the EU’s GDP is heavily dependent on trade and export and benefits from trade and investment based on rules and whereas an ambitious and balanced agreement with the US should support the reindustrialisation of Europe and help to achieve the 2020 target for an increase in the EU’s GDP generated by industry from 15 % to 20 % by strengthening trans-atlantic trade in both goods and services; whereas it has the potential to create opportunities especially for SMEs, micro enterprises (in accordance with the definition of Commission Recommendation 2003/361/EC), clusters and enterprise networks which suffer disproportionally more from non-tariff barriers (NTBs) than larger companies, as the latter have economies of scale that allow them easier access to markets on both sides of the Atlantic; whereas an agreement between the two biggest economic blocs in the world has the potential to create standards, norms and rules, which will be adopted at a global level, which would serve to the advantage of third countries as well and which would prevent a further fragmentation of world trade; whereas failure to negotiate an agreement will allow other third countries with different standards and values to assume this role instead;

Points out that, while the scope of the agreement concerns classified information on matters other than those in the area of the common foreign and security policy, international agreements under Article 218(6) TFEU which do not relate exclusively to the common foreign and security policy ('mixed' agreements) are covered by the agreement, including any part thereof that falls under the common foreign and security policy; underlines, moreover, that access by Parliament to any classified information which relates exclusively to the common foreign and security policy will continue to be governed by arrangements under an ad hoc Council decision or under the Interinstitutional Agreement of 20 November 2002 concerning access by the European Parliament to sensitive information of the Council in the field of security and defence policy (‘the 2002 Interinstitutional Agreement’) until other arrangements are agreed;

4. 4. The dialogue shall focus, inter alia, on specific political issues of mutual concern or of general significance for the attainment of the objectives of this Agreement, such as the arms trade, excessive military expenditure, drugs, organised crime or child labour, or discrimination of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.

Les informations non documentaires à ne pas divulguer ou autres informations confidentielles ou protégées fournies lors de séminaires ou autres réunions organisés dans le cadre du présent accord, ou les informations résultant de l’affectation de personnel, de l’utilisation d’installations ou de projets communs, sont traitées par les parties ou leurs participants conformément aux principes stipulés dans le présent accord pour les informations documentaires, à condition toutefois que le destinataire de ces informations à ne pas divulguer ou autres informations confidentielles ou protégées ait été averti par écrit de leur caractère confidentiel au moment de leur communication.
Non-documentary undisclosed or other confidential information provided in seminars and other meetings arranged under the Agreement, or information arising from the attachment of staff, use of facilities, or participation in joint projects, shall be treated by the Parties or their participants according to the principles specified for documentary information in the Agreement, provided, however, that the recipient of such undisclosed or other confidential or privileged information has been made aware of the confidential character of the information at the time it was communicated.

5. Dans le cadre du présent accord, les fonds alloués par le cadre financier pluriannuel de coopération au titre du présent accord, des ressources propres provenant de la Banque européenne d'investissement (ci-après dénommée «la Banque») et, le cas échéant, d'autres ressources provenant du budget de la Communauté européenne sont utilisés pour financer les projets, programmes et autres formes d'action contribuant à la réalisation des objectifs du présent accord.
5. In the framework of the Agreement, the funds earmarked under the multi-annual financial framework of cooperation under this Agreement, own resources of the European Investment Bank (hereinafter referred to as the Bank) and where appropriate other resources drawn from the European Community's budget, shall be used to finance projects, programmes and other forms of operations contributing to the achievement of the objectives of this Agreement.
