In order to ensure the coherence and effectiveness of Community assistance, the Commission may decide that non-ACP developing countries and regional integration bodies with ACP participation that promote regional cooperation and integration eligible for Community Assistance under Regulation (EC) No 1905/2006, Regulation (EC) No 1638/2006 of the European Parliament and of the Council of 24 October 2006 establishing a European Neighbourhood and Partnership instrument (14), the OCTs eligible for Community assistance under Decision 2001/822/EC, and the Community's outermost regions are eligible for funds referred to in Article 1(2)(a)(i) of the Internal Agreement, where the project or programme concerned is of a regional or cross-border nature and complies with Article 6 of Annex IV of the ACP-EC Partnership Agreement.

Pursuant to Article 1(1) of Protocol 3 on ACP sugar (hereinafter referred to as the ACP Protocol) attached to Annex V to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (hereinafter referred to as the ACP-EC Partnership Agreement), and Article 1(1) of the Agreement between the European Economic Community and the Republic of India on cane sugar (hereinafter referred to as the Agreement with India), the Community undertakes to purchase and import, at guaranteed prices, specific quantities of cane sugar which originate in the ACP States and India respectively and which those States undertake to deliver to it.

Annex Ia to the ACP-EC Partnership Agreement concerning the multiannual financial framework of cooperation under the ACP-EC Partnership Agreement for the period after the Ninth European Development Fund (EDF) states that the European Union shall maintain its aid effort to ACP States under the ACP-EC Partnership Agreement at least at the same level as that of the Ninth EDF, also adding the effects of inflation, growth within the EU and enlargement to 10 new Member States in 2004, but does not specify the exact period covered (five or six years), the amount or the financing instrument (general budget or new EDF).

Such contribution will be taken from the uncommitted balance of the allocation referred to in Article 3(2)(b) of Annex IV to the ACP-EC Partnership Agreement, the so-called B-allocation. If the uncommitted balance of the B-allocation is insufficient, the remainder will be taken from the uncommitted balance of the allocation referred to in Article 3(2)(a) of Annex IV, the so-called A-allocation. A total amount of EUR 126,4 million shall thus be transferred from the respective country allocations to the intra-ACP allocation under the envelope for regional cooperation and integration and used for the creation of a Peace Facility for Africa.

Comme Lomé IV, l'Accord de Partenariat ACP-CE prévoit que les crédits concernés s'ajoutent aux crédits alloués aux ACP dans le cadre de l'accord et qu'une attention particulière sera accordée à l'accélération de la diversification économique, pour favoriser la complémentarité des productions, l'intensification de la coopération et du développement entre les Etats ACP mais aussi entre ceux-ci, les PTOM et les DOM.
As in Lomé IV, the ACP-EC Partnership Agreement stipulates that the funding in question is to be added to the funding for the ACP States under the Agreement and that particular attention will be paid to speeding up economic diversification so as to encourage complementarity of production and intensify cooperation and development between the ACP States themselves and between them, the overseas countries and territories and the French overseas departments.
