À cet égard, il y a lieu de rappeler, tout d’abord, que, selon une jurisprudence constante relative aux pourvois introduits par l’institution défenderesse en première instance contre une décision ayant donné gain de cause au fonctionnaire, la recevabilité du pourvoi est conditionnée à l’existence d’un intérêt à agir, laquelle suppose que le pourvoi soit susceptible, par son résultat, de procurer un bénéfice à la partie qui l’a intenté (arrêts de la Cour du 13 juillet 2000, Parlement/Richard, C‑174/99 P, Rec. p. I‑6189, point 33, et du 3 avril 2003, Parlement/Samper, C‑277/01 P, Rec. p. I‑3019, point 28).
It must be recalled, first, in that regard that, according to settled case-law regarding appeals brought by an institution which was the defendant at first instance against a judgment in favour of an official, the admissibility of the appeal is subject to the existence of a legal interest in bringing the proceedings, which presupposes that the appeal must be liable, if successful, to procure an advantage to the party bringing it (Case C‑174/99 P Parliament v Richard [2000] ECR I‑6189, paragraph 33, and Case C‑277/01 P Parliament v Samper [2003] ECR I‑3019, paragraph 28).

It added that while, in its observations in the case giving rise to the judgment of 23 October 2008 in People’s Mojahedin Organization of Iran v Council, the Council expressly stated its intention of taking a position, as a matter of urgency, on ‘new elements’ brought to its attention, that institution nevertheless refrained from forwarding them to the PMOI, without claiming that any factual or legal obstacle prevented its doing so, even though the General Court had, by its judgment in People’s Mojahedin Organization of Iran v Council, annulled one of its earlier decisions, precisely on the ground that no such communication had been made before the decision was adopted.

The Court has consistently held that for an appellant to have an interest in bringing proceedings the appeal must be capable, if successful, of procuring an advantage to the party bringing it (see, in particular, Case C‑535/06 P Moser Baer India v Council [2009] ECR I‑7051, paragraph 24 and case-law cited).

5 Par son arrêt précité, la Court of Appeal a confirmé les appréciations de la POAC. In its judgment, the Court of Appeal upheld the POAC’s findings and moreover stated that the closed material adduced by the Home Secretary reinforced the Court of Appeal’s conclusion that the Home Secretary could not reasonably have considered that the PMOI intended in future to revert to terrorism.

Lastly, both the Commission in the contested decision and the General Court in the judgment under appeal misinterpreted the appellant’s intentions, attributing to it the aim of contriving to render a decision which referred to a general scheme one that concerned it individually and, as a result of that misunderstanding, incorrectly failed to consider the impact which the factors brought to their attention by the appellant could have had on the assessment of the scope of the aid scheme in general terms.
