Madame la Présidente, mesdames et messieurs, ce rapport contient dès lors des amendements à la proposition d’une décision-cadre du Conseil qui, selon nous, vient enrichir celle-ci sur le plan technique et la rend politiquement plus solide, en particulier en ce qui concerne les procédures de citation des prévenus et la garantie de leurs droits de défense, la possibilité pour les prévenus d’être représentés en leur absence et d’être représentés par un conseiller juridique désigné et rétribué par l’État ainsi que la possibilité d’une révision de procès ou de recours appropriés, conformément aux législations nationales, suscitées par le prévenu déjà jugé in absentia.
Madam President, ladies and gentlemen, this report therefore contains amendments to the proposal for a Council framework decision which, in our opinion, technically enrich this and make it politically robust, particularly with regard to the procedures for summoning defendants and the guarantee of their rights of defence, the possibility of the defendant being represented in his absence and being represented by a legal counsellor appointed and paid by the State and also the possibility of a retrial or appropriate appeal, in accordance with national laws, to be instigated by the defendant already judged in absentia.
