(8) In respect of the consumer products subject to this Regulation the scope of application of the different parts of it should be clearly delimited from sector-specific Union harmonisation legislation.

(9) Afin de garantir une cohérence, pour les obligations spécifiques des opérateurs économiques, entre le présent règlement et la législation sectorielle d'harmonisation de l'Union, il convient que les dispositions applicables aux fabricants, mandataires, importateurs et distributeurs se fondent sur les dispositions de référence figurant dans la décision n° 768/2008/CE du Parlement européen et du Conseil du 9 juillet 2008 relative à un cadre commun pour la commercialisation des produits .
(9) In order to ensure consistency between this Regulation and sector-specific Union harmonisation legislation with regard to specific obligations of economic operators, the provisions concerning manufacturers, authorised representatives, importers and distributors should be based on the reference provisions included in Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products .

La proposition jointe vise à clarifier le cadre réglementant les produits de consommation, en tenant compte des initiatives législatives de ces dernières années, telles que le nouveau cadre législatif sur la commercialisation des produits arrêté en 2008[3], l’adaptation[4] à ce nouveau cadre de la législation sectorielle d’harmonisation adoptée par l’Union et l’entrée en vigueur, le 1er janvier 2013, d’un nouveau règlement relatif à la normalisation européenne[5].
This proposal aims at clarifying the regulatory framework for consumer products taking into account legislative developments in recent years such as the New Legislative Framework on the Marketing of Products adopted in 2008[3], the alignment of sector-specific Union harmonisation legislation to that new framework[4] and the entry into application on 1 January 2013 of a new Regulation on European standardisation[5].

(7) Bien que l’Union élabore une législation sectorielle d’harmonisation portant sur la sécurité de certains produits ou certaines catégories de produits, il lui est pratiquement impossible d’adopter des dispositions législatives pour tous les produits de consommation existants ou susceptibles d’être conçus.
(7) Despite the development of sector-specific Union harmonisation legislation that addresses safety aspects of specific products or categories of products, it is practically impossible to adopt Union legislation for all consumer products that exist or may be developed.

Les produits de consommation qui respecteront les dispositions de la législation sectorielle d’harmonisation de l’Union visant à préserver la santé et la sécurité de la population seront aussi présumés sûrs en vertu du règlement proposé.
Consumer products that comply with sector-specific Union harmonisation legislation that aims at ensuring the health and safety of persons shall be presumed to be safe also under this proposed Regulation.

La superposition des règles de surveillance du marché et des obligations incombant aux opérateurs économiques établies dans divers instruments législatifs de l’Union (DSGP, règlement (CE) n° 765/2008 fixant les prescriptions relatives à l’accréditation et à la surveillance du marché pour la commercialisation des produits[2], et législation sectorielle d’harmonisation couvrant également des produits de consommation) est devenue une source de confusion tant pour les opérateurs économiques que pour les autorités nationales, ce qui entrave gravement l’efficacité de la surveillance du marché dans l’Union.
Overlaps of market surveillance rules and obligations of economic operators laid down in various pieces of Union legislation (the GPSD, the Regulation (EC) No 765/2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products[2] and sector-specific Union harmonisation legislation that also covers consumer products) has led to confusion on the part of both economic operators and national authorities and has seriously hampered the effectiveness of market surveillance activity in the Union.

Afin de garantir que les produits bénéficiant de la liberté de circulation des marchandises au sein de la Communauté répondent aux exigences d'un haut niveau de protection des intérêts publics tels que la santé et la sécurité en général, la santé et la sécurité sur le lieu de travail, la protection des consommateurs et la protection de l'environnement, tout en garantissant que la libre circulation des produits n'est pas restreinte au-delà de ce qui est autorisé en vertu de la législation communautaire d'harmonisation ou d'autres règles communautaires pertinentes, le présent règlement fournit un cadre d'appui pour les règles spécifiques de la législation communautaire d'harmonisation sectorielle existante ou future sans apporter de modification notable à ladite législation, en particulier en ce qui concerne les règles de ladite législation en matière de protection de la santé et de l'environnement et toute règle spécifique relative à l'accréditation et à la surveillance du marché que peut contenir ladite législation.
1. To ensure that products benefiting from the free movement of goods within the Community respect a high level of protection of public interests such as health and safety in general, health and safety at the workplace, protection of consumers and of the environment, while ensuring that the free movement of products is not restricted beyond what is allowed under Community harmonisation legislation and any other relevant Community rules, this Regulation provides a framework supporting specific rules of existing and future sectoral Community harmonisation legislation, without making any substantive changes to that legislation, in particular not to rules contained therein relating to protection of health and the environment and any specific rules on accreditation and market surveillance that may be contained therein.

Ces programmes d’accréditation sectorielle identifient les spécifications techniques sectorielles nécessaires pour garantir le niveau de compétence requis par la législation communautaire d’harmonisation dans des domaines technologiques spécifiques ou des domaines concernés par des exigences de santé et de sécurité.
Such schemes shall identify the sectoral technical specifications necessary to ensure the level of competence required by Community harmonisation legislation in fields with specific technology or health and safety related requirements.
