TRADUCTIONS EN CONTEXTE

Si la législation qu’applique l’institution prioritairement compétente ne prévoit pas de disposition lui permettant d’accorder ces prestations familiales supplémentaires ou spéciales pour orphelins, cette institution transmet sans délai toute demande d’octroi de prestations familiales, accompagnée de tous les documents et renseignements nécessaires, à l’institution de l’État membre à la législation duquel l’intéressé a été soumis le plus longtemps, et qui prévoit de telles prestations familiales supplémentaires ou spéciales pour orphelins.
If there is no provision for the institution competent to grant, by priority right, such additional or special family benefits for orphans under the legislation it applies, it shall without delay forward any application for family benefits, together with all relevant documents and information, to the institution of the Member State to whose legislation the person concerned has been subject, for the longest period of time and which provides such additional or special family benefits for orphans.

2. En cas de divergence de vues entre les institutions ou les autorités de deux États membres ou plus au sujet de la détermination de l’institution appelée à servir les prestations en espèces ou en nature, la personne concernée qui pourrait prétendre à des prestations s’il n’y avait pas de contestation bénéficie à titre provisoire des prestations prévues par la législation qu’applique l’institution de son lieu de résidence ou, si elle ne réside pas sur le territoire de l’un des États membres en cause, des prestations prévues par la législation qu’applique l’institution à laquelle la demande a été présentée en premier lieu.
2. Where there is a difference of views between the institutions or authorities of two or more Member States about which institution should provide the benefits in cash or in kind, the person concerned who could claim benefits if there was no dispute shall be entitled, on a provisional basis, to the benefits provided for by the legislation applied by the institution of his place of residence or, if that person does not reside on the territory of one of the Member States concerned, to the benefits provided for by the legislation applied by the institution to which the request was first submitted.

2. Si le droit aux prestations est ouvert au titre de la législation qu’applique l’institution à laquelle la déclaration ou notification a été transmise, cette institution verse des avances dont le montant est déterminé, le cas échéant, après consultation de l’institution contre la décision de laquelle le recours a été introduit et de manière à éviter les sommes versées en trop.
2. Where a person is entitled to benefits under the legislation applied by the institution to which the declaration or notification was sent, that institution shall make the advance payments, the amount of which shall be determined, where appropriate, after consulting the institution which made the decision against which the appeal was lodged, and in such a way that overpayments are avoided.
