1. Lorsqu’un accident du travail survient ou lorsqu’une maladie professionnelle est médicalement constatée pour la première fois sur le territoire d’un État membre autre que l’État membre compétent, et si la déclaration ou la notification est prévue par la législation nationale, la déclaration ou la notification de l’accident du travail ou de la maladie professionnelle est effectuée conformément à la législation de l’État membre compétent, sans préjudice, le cas échéant, de toute autre disposition légale en vigueur sur le territoire de l’État membre où est survenu l’accident du travail ou dans lequel a été faite la première constatation médicale de la maladie professionnelle, qui reste applicable dans un tel cas.
1. If an accident at work occurs or an occupational disease is diagnosed for the first time in a Member State other than the competent Member State, the declaration or notification of the accident at work or the occupational disease, where the declaration or notification exists under national legislation, shall be carried out in accordance with the legislation of the competent Member State, without prejudice, where appropriate, to any other applicable legal provisions in force in the Member State in which the accident at work occurred or in which the first medical diagnosis of the occupational disease was made, which remain applicable in such cases.

La Commission européenne a demandé à la Pologne de mettre sa législation nationale relative à l'évaluation et à la gestion des risques d'inondation en conformité avec la directive relative aux inondations (2007/60/CE). La directive a pour objectif la réduction et la gestion des risques que les inondations font peser sur la santé humaine, l’environnement, l’activité économique et le patrimoine culturel. En vertu de la législation de l'Union, les États membres doivent procéder à des évaluations des risques d'inondation de leurs bassins hydrographiques et établir des plans d'urgence.La Commission a relevé des lacunes dans la transposition de cette directive par la Pologne dans sa législation nationale et lui a adressé une lettre de mise en demeure le 18 octobre 2013. La Pologne a ensuite notifié la modification de la législation relative à l’eau mais la transposition de la définition d’«inondation» reste problématique, dans la mesure où elle restreint le champ d’application de la directive en excluant certaines causes d’inondation, ce qui peut avoir une incidence sur la mise en œuvre de l’ensemble de la directive en Pologne. La Commission a donc décidé de lui adresser un avis motivé. Si la Pologne ne donne pas suite dans un délai de deux mois, la Commission pourra saisir la Cour de justice de l'UE.
The European Commission has requested Poland to bring its national laws on the assessment and management of flood risks into line with the Floods Directive (2007/60/EC. The Directive aims to reduce and manage the risks that floods pose to human health, the environment, economic activity and cultural heritage. Under EU law, Member States have to perform flood risk assessments for their river basins, and draw up emergency plans.The Commission identified shortcomings in Poland's transposition of this legislation into its domestic law, and sent a letter of formal notice on 18 October 2013. Poland subsequently notified the amended Water Act, but the transposition of the definition of 'flood' still remains problematic as it restricts the scope of the Directive by excluding some sources of flooding, which may have an impact on the implementation of the whole Directive in Poland. The Commission is therefore sending a reasoned opinion. If Poland fails to act within two months, the Commission may refer Poland the EU Court of Justice.

With all the White Paper proposals already tabled, efforts must now focus on: (a) securing Council agreement on the White Paper proposals still awaiting adoption, particularly in key areas such as indirect taxation, transport, services, and the animal and plant health fields; 1991 will be the last year for completing this part of the process, since 1992 will be needed for the transposition of the ensuing directives and other Community instruments into national law; - 3 - (b) presenting some further proposals not included in the White Paper but needed to complete the picture; (c) keeping up the pressure on Member States to speed up the transposition into national law of the Community instruments already enacted; (d) playing an active role in the intergovernmental work - mainly on the elimination of frontier controls - which is putting in place the instruments needed to establish the frontier-free area.
