IN-CONTEXT TRANSLATIONS

(a) si une personne est assujettie au Régime de pensions du Canada, ou au régime général de pensions d’une province du Canada, pendant une période quelconque de résidence sur le territoire du Luxembourg, cette période de résidence est considérée comme une période de résidence au Canada, relativement à cette personne, à son conjoint et aux personnes à sa charge qui demeurent avec elle et qui ne sont pas assujettis à la législation du Luxembourg en raison d’une activité professionnelle pendant ladite période;
(a) if a person is subject to the Canada Pension Plan or to the comprehensive pension plan of a province of Canada during any period of residence in the territory of Luxembourg, that period of residence shall be considered as a period of residence in Canada for that person as well as for that person’s spouse and dependants who reside with him or her and who are not subject to the legislation of Luxembourg by reason of a professional activity during that period;

Le travailleur salarié qui, à défaut de la présente Convention, serait soumis à la législation de l’une et l’autre des Parties en ce qui concerne un emploi comme membre de l’équipage d’un navire, est assujetti, en ce qui a trait à cet emploi, uniquement à la législation du Canada s’il réside habituellement au Canada et uniquement à la législation du Luxembourg dans tout autre cas.
4. A person who, but for this Convention, would be subject to the legislation of both Parties in respect of employment as a member of the crew of a ship shall, in respect of that employment, be subject only to the legislation of Canada if he ordinarily resides in Canada and only to the legislation of Luxembourg in any other case.

(b) if a person is subject to the legislation of Luxembourg by reason of a professional activity during any period of residence in the territory of Canada, that period of residence shall not be considered as a period of residence in Canada for that person and for that person’s spouse and dependants who reside with him or her and who are not subject to the Canada Pension Plan or to the comprehensive pension plan of a province of Canada by reason of employment during that period.

(4) En réponse aux préoccupations liées à la question du bien-être animal en rapport avec la mise à mort et l’écorchage des phoques, plusieurs États membres, à savoir l'Autriche, la Belgique, la France, l'Allemagne, l'Italie, le Luxembourg, les Pays-Bas et la Slovénie, ainsi que, à l'échelle internationale, la Croatie, le Mexique, Panama, la Suisse et les États-Unis, ont adopté, ou ont l’intention d’adopter, des mesures législatives règlementant le commerce des produits dérivés du phoque, en grande partie pour des raisons éthiques liées au bien-être des animaux, en interdisant leur importation et leur production, alors que dans d’autres États membres le commerce de ces produits ne fait l’objet d’aucune restriction.
(4) In response to the concern about the animal welfare aspects of the killing and skinning of seals, several Member States, including Belgium, Germany, France, Italy, Luxembourg, the Netherlands, Austria and Slovenia, as well as, internationally, Croatia, Mexico, Panama, Switzerland and the United States of America, have adopted or intend to adopt legislation regulating trade in seal products, largely on the basis of ethical considerations related to animal welfare, by prohibiting their import, and production, while no restrictions are placed on the trade in these products in other Member States.

Secondly, the Commission has made formal requests asking four Member States to amend their legislation: Luxembourg, for its system of awarding work permits to non-EU nationals; Finland, for its rules on patient mobility; Italy, for its rules on company vehicle registration; and Spain, for its rules on tourist rental of properties in the Canary Islands.

The main reason to revise the legislation is the numerous judgments issued by the Court of Justice in Luxembourg against various countries for failure to transpose the European legislation, or their slowness in doing so, or what could be called an insufficient definition of the basic concepts in the previous directives.

Dans le cadre du contrôle de l’application du droit communautaire, la Commission a entamé la procédure d’infraction contre l’Irlande, la Suède, le Luxembourg et Malte, par l’envoi, en date du 21 mars 2005, de lettres de mise en demeure. En effet, la Commission constate que ces États membres n’ont pas encore désigné l’organisme chargé de l’application dudit règlement (Malte, Irlande et Luxembourg ) ni adopté dans leur législation nationale les sanctions pour la violation du règlement (Suède, Malte, Irlande et Luxembourg).
In connection with monitoring the application of Community law, the Commission began infringement proceedings against Ireland, Sweden, Luxembourg and Malta on 21 March 2005 by sending them letters of formal notice as these Member States have not yet designated the body responsible for enforcement of the Regulation (Malta, Ireland and Luxembourg) or introduced into their national legislation sanctions for breaches of the Regulation (Sweden, Malta, Ireland and Luxembourg).

7. Stresses that, in response to the Erika and Prestige disasters, important legislative measures have been taken to make shipping safer in European waters and that rapid and complete introduction and strict enforcement of the European rules by the Member States must therefore be a priority; deplores the fact, in this connection, that seven Member States (Italy, Austria, Luxembourg, Greece, Finland, Belgium and the Netherlands) have still not transposed, or have still not completely transposed, two crucial directives on port state control and classification societies;
