TRADUCTIONS EN CONTEXTE

De l’avis de la juridiction constitutionnelle autrichienne, la Charte est opposable dans les procédures de contrôle juridictionnel de la législation nationale dont elle est saisie; par conséquent, les justiciables peuvent se prévaloir des droits et des principes reconnus dans la Charte lorsqu’ils contestent la légalité d’une législation de droit interne. La juridiction autrichienne a relevé de fortes similitudes entre le rôle joué par la Charte dans le système juridique de l’Union et celui joué par la convention européenne des droits de l’homme (CEDH) dans le cadre de la constitution autrichienne selon laquelle ladite convention a une valeur constitutionnelle.
It took the view that the Charter is enforceable in the proceedings brought before it for the judicial review of national legislation, and therefore individuals can rely upon the rights and the principles recognised in the Charter when challenging the lawfulness of domestic legislation. The Austrian Constitutional Court identified strong similarities between the role played by the Charter in the EU legal system and that played by the ECHR under the Austrian Constitution, according to which the ECHR has force of constitutional law.

These amendments brought reactions from the Romanian magistracy,[36] and from the international community.[37] One issue raised was the fact that the UN Convention on Corruption states that all public officials holding legislative, executive, administrative or judicial office should be covered by corruption and conflict of interest rules.[38] The Constitutional Court of Romania ruled in January 2014 that the amendments were unconstitutional, citing in particular the need to respect obligations stemming from international law, as well as the principle of equality before the law enshrined in the Romanian Constitution.

Les événements survenus récemment en Pologne, en particulier le différend politique et juridique concernant la composition du Tribunal constitutionnel, l'absence de publication des décisions rendues par ce dernier, ainsi que la révision de la loi relative au Tribunal constitutionnel et son incidence sur l’efficacité du contrôle de constitutionnalité de la nouvelle législation suscitent des inquiétudes quant au respect de l'état de droit.
Recent events in Poland, in particular the political and legal dispute concerning the composition of the Constitutional Tribunal, the non-publication of judgments rendered by the Constitutional Tribunal, as well as the review of the law on the Constitutional Tribunal and its impact on the effectiveness of constitutional review of new legislation have given rise to concerns regarding the respect of the rule of law.

Plus particulièrement, je voudrais mentionner la communication de la Commission sur la protection des données, que vous devriez présenter comme une véritable occasion d’aligner, d’une part, la révolution des technologies et des outils de connaissance et, d’autre part, l’évolution de la législation constitutionnelle européenne, comme le traité de Lisbonne et la charte européenne des droits fondamentaux, les droits fondamentaux à la vie privée et tous les droits liés à l’accès, à la rectification et à la suppression des données à caractère personnel, conformément au libre consentement donné par les citoyens européens, mais aussi conformément au droit international.
In particular, I should like to mention the Commission communication on data protection, which you should present as a real opportunity to bring into alignment the revolution in technology and knowledge tools, on the one hand, and, on the other, advances in European constitutional law like the Treaty of Lisbon and the European Charter of Fundamental Rights, fundamental rights to privacy, and all rights linked to accessing, rectifying and cancelling any personal data, in line with the European public’s freedom to give their consent, but also in line with international law.

La Commission procède actuellement à l’évaluation de cet instrument et doit présenter son rapport d’évaluation au Parlement européen et au Conseil à la fin 2010.
The German constitutional court found that the rules governing access to and the use of the data, as laid down in national law, were unconstitutional.[43] The Romanian constitutional court found that data retention per se breached Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) and was thus unconstitutional.[44] The Commission is currently evaluating this instrument and is to submit its assessment report to the European Parliament and the Council in late 2010.
