(27) Member States should further exploit the possibilities foreseen under Article 16 of Regulation (EC) No 883/2004 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems to provide by common agreement for exceptions to Articles 11 to 15 ( Determination of the legislation applicable) of that Regulation in the interest of certain persons or categories of persons and to consider the staff of EGTCs as being such a category of persons.

D. whereas on 22 April 2015 the Commission deplored in the explanatory memorandum of its legislative proposal amending Regulation (EC) No 1829/2003 the fact that, since the entry into force of Regulation (EC) No 1829/2003, authorisation decisions had been adopted by the Commission, in accordance with the applicable legislation, without the support of the opinions of Member State committees and that the return of the dossier to the Commission for the final decision, which was very much the exception for the procedure as a whole, had become the norm for decision-making on genetically modified (GM) food and feed authorisations;

Lorsque la législation d’une Partie est applicable dans le cas d’option aux termes des dispositions du paragraphe 5 de l’article VI de l’Accord ou d’un accord entre les autorités compétentes aux termes des dispositions du paragraphe 6 dudit article, l’institution de ladite Partie émettra un certificat attestant qu’en ce qui concerne ce travail ou cet emploi le travailleur est assujetti à ladite législation.
3. When the legislation of a Party is applicable by reason of an election under paragraph 5 of Article VI of the Agreement or agreement of the competent authorities under paragraph 6 of that Article, the institution of that party will issue a certificate certifying in respect of the work or employment in question, that the employed person is subject to that legislation.

3. Une prestation en application de la législation d’une Partie accordée à une personne qui est ou a été soumise à la législation de l’autre Partie, ainsi qu’autres personnes qui dérivent des droits de cette personne, est payable lorsque ladite personne ou lesdites personnes résident habituellement sur le territoire d’un État tiers aux mêmes conditions qu’un ressortissant de la première Partie qui réside habituellement sur le territoire dudit État tiers.
3. A benefit under the legislation of one Party which is payable to a person who is or has been subject to the legislation of the other Party, as well as other persons who derive rights from such a person, shall be paid when that person or those persons ordinarily reside in the territory of a third State under the same conditions as it would to a national of the first Party who ordinarily resides in the territory of that third State.

Lorsque la législation d’un État contractant prévoit que tout document soumis à l’autorité compétente ou à l’agence dudit État contractant est exempté, en tout ou en partie, des frais ou droits, y compris des frais consulaires et administratifs, l’exemption s’applique également aux documents correspondants qui sont soumis à l’autorité compétente ou à l’agence de l’autre État contractant suite à l’application du présent Accord.
Where the legislation of a Contracting State provides that any document which is submitted to the competent authority or agency of that Contracting State shall be exempted, wholly or partly, from fees or charges, including consular and administrative fees, the exemption shall also apply to corresponding documents which are submitted to the competent authority or agency of the other Contracting State in the application of this Agreement.

Sauf si les lois nationales d’un État contractant ne requièrent le contraire, les renseignements relatifs à une personne qui sont transmis conformément au présent Accord à l’autorité compétente ou à l’agence dudit État contractant par l’autorité compétente ou l’agence de l’autre État contractant ne peuvent être utilisés qu’aux seules fins de l’application de l’Accord et de la législation à laquelle l’Accord s’applique.
Unless otherwise required by the national statutes of a Contracting State, information about an individual which is transmitted in accordance with this Agreement to the competent authority or agency of that Contracting State by the competent authority or agency of the other Contracting State shall be used exclusively for purposes of implementing this Agreement and the legislation to which this Agreement applies.

Sauf dispositions contraires du présent Accord, la législation de l’un des États contractants qui exige que le droit aux prestations en espèces ou que le versement de ces prestations soit subordonné à la résidence sur le territoire dudit État contractant n’est pas applicable aux personnes spécifiées aux alinéas a), b), c) et d) de l’article 3 qui résident sur le territoire de l’autre État contractant.
Unless otherwise provided in this Agreement, the legislation of one Contracting State which requires that entitlement to or the payment of cash benefits be dependent on residence in the territory of that Contracting State shall not be applicable to the persons specified in subparagraphs (a), (b), (c) and (d) of Article 3 who reside in the territory of the other Contracting State.
