We naturally respect the independence of the legislative process in Afghanistan, in particular with regard to the Constitution, which does indeed make provision, under Article 131, for the possibility of legislation devoted solely to the Shiite community. Nevertheless, along with our partners we have supported an approach targeting certain articles of that law that are scarcely compatible with the Afghan Constitution or the international law that the Afghan Government has signed up to.

Ce que je retiens de la note de service, c'est que les modifications visent quatre objectifs: reléguer au conseiller législatif le soin de rédiger uniquement les projets de loi d'initiative parlementaire; déléguer aux greffiers à la procédure le soin de rédiger les amendements aux projets de loi d'initiative ministérielle, fonction qui était autrefois exécutée par le conseiller législatif; le conseiller législatif ne peut plus donner aux députés des avis juridiques sur les projets de loi d'initiative ministérielle ou les amendements à ceux-ci, ni à titre particulier, ni au sein des comités; les amendements aux initiatives ministérielles proposés par les députés s'en trouvent aussi réduits à des amendements rédigés dans une langue compatible et ne sont plus des amendements crédibles, qui ont force obligatoire et qui sont rédigés par un conseiller législatif, service auquel nous avons été habitués pendant la dernière législature.
As I understand the memorandum, the changes include four things: relegating legislative counsel to drafting only private members' bills; delegating procedural clerks to draft amendments to government bills, a function that used to be performed by legislative counsel; prohibiting legislative counsel from providing legal advice to members in relation to government bills or amendments to government bills either in private or in committee; restricting the drafting of members' amendments of government bills to compatible language as opposed to credible, legally binding amendments drafted by legislative counsel, a service to which we were accustomed in the previous Parliament.
